Is Accounting in Schools Considered Official?
According to Article 2 of Decree 06/2010/ND-CP, the criteria for determining an official are as follows:
An official is a Vietnamese citizen who is recruited and appointed into grades, positions, titles within the staffing quota, receiving a salary from the state budget or guaranteed from the salary fund of a public service provider according to the provisions of the law, working in agencies, organizations, and units stipulated in this Decree.
Additionally, Article 11 of this Decree provides regulations on officials in the leadership and management apparatus of public service providers as follows:
Public service providers mentioned in this Decree are organizations established and managed by the competent authority of the Communist Party, state agencies, and socio-political organizations according to the provisions of the law, having legal personality, their own seals, and accounts, and operating in fields such as education, training, healthcare, scientific research, culture, sports, tourism, labor - invalids, and social affairs, information and communication, and other fields as prescribed by law.
Heads, deputies of heads; those holding managerial positions of public service providers under the Politburo, the Secretariat, the Standing Committee of the National Assembly, the Government of Vietnam.
Heads, deputies of heads of public service providers funded by the state budget belonging to the Central Committees and equivalent agencies of the Communist Party, Office of the President, Office of the National Assembly, State Audit Office, Supreme People's Procuracy, Supreme People's Court, central agencies of socio-political organizations, Ministries, Ministerial-level agencies, agencies under the Government of Vietnam, the Prime Minister of the Government of Vietnam.
Heads of public service providers funded by the state budget belonging to General Departments, Departments, and equivalents under Ministries, Ministerial-level agencies; provincial Party Committees, municipal Party Committees; People's Committees at the provincial level; provincial-level socio-political organizations; district Party Committees, town Party Committees, and city Party Committees under provincial Party Committees; specialized agencies under the provincial People’s Committees, specialized agencies under district People’s Committees.
Persons holding positions associated with state management tasks in public service providers assigned to perform state management tasks.
Therefore, in the case of your cousin who is an accountant in a school, she does not qualify as an official.
