How to Receive a One-Time Social Insurance Payment When You Have New Employment?
According to Clause 1, Article 8 of Decree 115/2015/ND-CP, if an employee ceases working for one year, has not accrued 20 years of social insurance contributions, and does not continue these contributions, they are entitled to a one-time social insurance payment upon request.
Accordingly, you have contributed to social insurance for 5 years, have ceased working for one year, and do not continue making contributions. Therefore, if you request it, you are entitled to a one-time social insurance payment.
Based on the information you provided, you have found new employment and will be contributing to social insurance. If you now wish to receive the one-time social insurance payment for your contributions at the previous company, you can still do so by following these steps:
- Submit your application for a one-time social insurance payment, including your Social Insurance Book and the One-Time Social Insurance Payment Request Form, to the social insurance agency.
- After receiving the payment for the one-time social insurance for the period of contributions at the previous company, you may proceed to sign an employment contract with the new company and contribute to social insurance. The contributions under the new social insurance period will be calculated separately and will not be cumulative.
