How many days from the submission of the application will the work permit be extended?
According to the provisions of Article 15 of Decree 11/2016/ND-CP, the procedure for re-issuing work permits is as follows:
- The employer must submit a dossier requesting the re-issuance of the work permit to the Department of Labor, Invalids and Social Affairs (DOLISA) that issued the work permit.
- Within 03 working days from the date of receipt of the complete dossier requesting the re-issuance of the work permit, the DOLISA shall re-issue the work permit. In case the work permit is not re-issued, a written response stating the reasons must be provided.
- For foreign workers entering Vietnam for the purpose of a labor contract, after the foreign worker has been re-issued the work permit, both the employer and the foreign worker must sign a written labor contract as prescribed by Vietnamese labor laws before the expected date of resuming work for the employer.
Within 05 working days from the date of signing the labor contract, the employer must send a copy of the signed labor contract to the DOLISA that re-issued the work permit.
Therefore, based on the above provisions, within 03 working days from the date of receipt of the complete dossier requesting the re-issuance of the work permit, the DOLISA shall re-issue the work permit.
If your dossier is complete and valid, within 03 working days from the date of submission, the DOLISA will re-issue the work permit for the foreign worker.
