How long is the duration of the employment service business license?
Pursuant to Clause 2, Article 16 of Decree 23/2021/ND-CP on the license for employment services operations as follows:
- The duration of the license is specified as follows:
a) The maximum duration of the license is 60 months;
b) The license may be renewed multiple times, each renewal not exceeding 60 months;
c) The duration of the reissued license shall be equal to the remaining duration of the previously issued license.

According to Clause 3, Article 6 of Decree 98/2020/ND-CP regarding violations in business operations according to the business license as follows:
- A monetary fine of 10,000,000 VND to 15,000,000 VND for one of the following violations:
a) Trading goods or services in investment business sectors with conditions without a business license as required;
b) Trading goods or services in investment business sectors with conditions when the issued business license has expired;
c) Trading goods or services in investment business sectors with conditions but failing to meet the investment business conditions stipulated during the business operations;
d) Using the business license of another trader for business.
In addition, Clause 7, Article 6 of Decree 98/2020/ND-CP, as amended by Clause 3 Article 3 of Decree 17/2022/ND-CP, specifies measures for rectification as follows:
- Measures for rectification:
a) Compelling the return of business licenses that have been erased, altered to change the content to the competent authority or person that issued the license for violations as stipulated at point a, clause 1 of this Article;
b) Compelling the return of illicit gains obtained from committing violations as stipulated at point b, clause 1, clauses 2, 3, 4 of this Article.
Thus, using an expired license may result in a fine ranging from 10,000,000 to 15,000,000 VND or the compelling return of illicit gains obtained from the violation.
