How Long Does It Take to Process a Work Permit Extension?
Article 16 of Decree 152/2020/ND-CP stipulates the conditions for renewing a work permit as follows:
The work permit that has been issued is still valid for at least 05 days but no more than 45 days.
Approved by the competent authority for the need to employ foreign workers as stipulated in Articles 4 or 5 of this Decree.
Documentation proving that the foreign worker continues to work for the employer in accordance with the content of the issued work permit.
According to the provisions of Clause 1 of this Article, if the work permit you mentioned is still valid for no more than 45 days and meets the two conditions stipulated in Clauses 2 and 3, you can apply for a work permit renewal according to regulations.
Within 05 working days from the date of receiving the complete application for work permit renewal, the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs will renew the work permit. In case of non-renewal of the work permit, a written response with specific reasons will be provided (Clause 2, Article 18 of this Decree).
The processing time for a work permit renewal request is within 05 working days from the date of receiving the complete application.
