How is the Salary Regulated from 2021?

Regarding the issue of salary in the labor contract, I would like to ask: How is the salary regulated according to the Labor Code 2019? Thank you!

1. What is Salary?

According to Article 90 of the Labor Code 2019 (Effective from January 1, 2021), regulations on salary are as follows:

- A salary is the amount of money that the employer pays to the employee as agreed upon for performing the job, including the wage per job or title, wage allowances, and other additional payments.

- The wage per job or title must not be lower than the minimum wage.

- The employer must ensure equal pay without discrimination based on gender for employees performing work of equal value.

Thus, a salary is the amount of money that the employer pays to the employee as agreed upon for performing the job, including the wage per job or title, wage allowances, and other additional payments.

2. What is the minimum wage?

- The minimum wage is the lowest wage paid to employees performing the simplest jobs under normal working conditions to ensure the minimum living standards for employees and their families, in line with socio-economic development conditions.

- The minimum wage is established based on regions and fixed on a monthly or hourly basis.

- The minimum wage is adjusted based on the minimum living standards of employees and their families; the correlation between the minimum wage and the market wage; consumer price index, economic growth rate; labor supply and demand; employment and unemployment; labor productivity; and the payment capability of enterprises.

- The Government of Vietnam details this Article; determines and announces the minimum wage based on the recommendations of the National Wage Council.

It can be seen that the minimum wage is the lowest wage paid to employees performing the simplest jobs under normal working conditions to ensure the minimum living standards for employees and their families, in line with socio-economic development conditions.

3. What is the current regional minimum wage?
