How is the Evaluation of Emulation for Teachers Having a Third Child Conducted?
Based on Article 27 of Regulation 102-QD/TW in 2017, the act of a Party member having a third child constitutes a violation of regulations on population policy and family planning, specifically as follows:
- If a Communist Party member violates any of the following cases causing less serious consequences or violates in the case of having a third child (except where the law has other provisions), the disciplinary action will be by reprimand.
On the other hand, based on Article 14 of Decree 56/2015/ND-CP on the evaluation and classification of public employees regarding the criteria for classifying and evaluating officials at the level of non-fulfillment of duties, specifically as follows:
A public employee will be classified and evaluated as not fulfilling the duties if they meet one of the following criteria:
Failure to implement or violation of the Party's lines, policies, and the state's policies and laws that result in stern criticism or disciplinary action by the competent authority according to regulations.
Thus, in this case, if you are a Communist Party member, based on the provisions of Article 14 of Decree 56/2015/ND-CP, your act constitutes a violation of the population policy. Your classification as not fulfilling the duties by the head of the agency, here the principal, is entirely in accordance with the legal provisions. If you are not a Communist Party member, currently, there is no prohibition on having a third child, so you will not be subject to disciplinary action.
