How is Night Shift Work Calculated for Wages?

Our company's working schedule is 5 days a week, 8 hours each day, regulated into 4 shifts as follows:Shift 1: 7:00 – 16:00Shift 2: 8:00 – 17:00Shift 3: 15:00 – 00:00 (rest time: 19:00-20:00)Shift 4: 23:00 – 8:00 (rest time: 3:00 - 4:00)(each shift has 1 hour of rest time).I would like to inquire if employees working in Shift 3 and 4 are paid 100% of their regular salary during working hours or if it should be considered overtime pay?

According to the provisions of Article 106 of the Labor Code 2019 (Labor Code 2019), night working hours are calculated from 10:00 PM to 6:00 AM the following day.

And under Clause 2, Article 98 of the Labor Code 2019, employees working at night are paid an additional amount of at least 30% of the wage calculated according to the wage unit price or the actual wage paid according to the job of a normal working day.

Based on the above regulations, the case of Ms. Chi will be calculated as follows:

For Shift 3: 3:00 PM - 12:00 AM

+ From 3:00 PM - 7:00 PM and 8:00 PM - 10:00 PM = 100% normal wage;

+ From 10:00 PM - 12:00 AM = pay an additional amount of at least 30% of the normal wage.

For Shift 4: 11:00 PM - 8:00 AM

+ 11:00 PM - 3:00 AM, 4:00 AM - 6:00 AM = pay an additional amount of at least 30% of the normal wage;

+ 6:00 AM - 8:00 AM = 100% normal wage.
