Extension of Work Permit Must Be Done 10 Days Before Expiration?
Article 16 of Decree 152/2020/ND-CP stipulates the conditions for extending a work permit as follows:
The issued work permit must be valid for at least 05 days but not more than 45 days.
Approval from the competent authority regarding the demand for using foreign workers as stipulated in Article 4 or Article 5 of this Decree.
Documents proving that the foreign worker continues to work for the employer under the content of the issued work permit.
Accordingly, the condition regarding the validity period of the work permit requires that the permit must be valid for at least 05 days and not more than 45 days. Therefore, a work permit valid for up to 45 days can proceed with the extension procedure, and the extension procedure must be completed at least 05 days before the permit expires. Hence, stating that the work permit must be renewed 10 days before its expiration is unsatisfactory above.
