Employer requires Employees to work overtime, Employees cannot refuse?
Based on Article 108 of the 2019 Labor Code which stipulates overtime in special cases as follows:
The employer has the right to require employees to work overtime on any day without being limited by the number of overtime hours as prescribed in Article 107 of this Code, and the employee is not allowed to refuse in the following cases:
- Executing orders for mobilization, ensuring national defense and security tasks as prescribed by law;
- Performing tasks aimed at protecting the lives of individuals, property of agencies, organizations, and individuals in preventing and overcoming the consequences of natural disasters, fires, dangerous epidemics, and disasters, except for cases where there is a risk of affecting the life and health of the employee as prescribed by the law on labor safety and sanitation.
Thus, in the aforementioned special cases the employer has the right to require the employee to work overtime on any day that the employee cannot refuse. Of course, employees may not refuse for objective reasons or health constraints.
