Duration of Apprenticeship According to the 2019 Labor Code
According to Article 61 of the 2019 Labor Code regarding Apprenticeship and On-the-job training for employers as follows:
- Apprenticeship for employers is when the employer recruits individuals to train for a profession at the workplace. The duration of the apprenticeship follows the training program for each level as prescribed by the Law on Vocational Education.
- On-the-job training for employers is when the employer recruits individuals to guide them in practical work, practicing the profession according to the job position at the workplace. The duration of on-the-job training shall not exceed 03 months.
- Employers recruiting individuals for apprenticeship or on-the-job training to work for them are not required to register vocational education activities; cannot charge tuition fees; must sign a training contract in accordance with the Law on Vocational Education.
- Individuals undergoing apprenticeship or on-the-job training must be 14 years of age or older and must have adequate health suitable for the requirements of the apprenticeship or on-the-job training. Individuals undergoing training in professions, heavy, hazardous, dangerous jobs, or especially heavy, hazardous, dangerous jobs as stipulated by the Minister of Labor, Invalids and Social Affairs must be 18 years of age or older, except in the fields of arts, physical education, and sports.
- During the apprenticeship or on-the-job training period, if the trainee directly or participates in labor, the employer shall pay wages as agreed upon by both parties.
- Upon the completion of the apprenticeship or on-the-job training period, both parties must sign a labor contract if they meet the conditions as prescribed by this Code.
Thus, according to the 2019 Labor Code, the duration of on-the-job training shall not exceed 03 months. Meanwhile, the current 2012 Labor Code does not specifically stipulate the duration of on-the-job training.
