Does the leave for social insurance benefits count towards the period for service allowance?
Pursuant to Clause 2c, Article 4 of Decree 34/2012/ND-CP, the regulations are as follows:
- Periods that are not eligible for civil service allowance include:
a) Time spent on business trips, studying, or working overseas during which 40% of the salary is paid in accordance with Clause 4, Article 8 of Decree No. 204/2004/ND-CP dated December 14, 2004, by the Government of Vietnam on salary policies for officials, public employees, and armed forces;
b) Continuous periods of unpaid leave lasting one month or more;
c) Periods of leave during which social insurance benefits are received according to the legal regulations on social insurance;
d) Periods of temporary suspension from work or temporary detention.
Therefore, time spent on leave and receiving social insurance benefits is not counted towards the period eligible for the civil service allowance.
