Does maternity leave count towards annual leave?
According to Article 65 of Decree 145/2020/ND-CP stipulating the time considered as working time to calculate the number of annual leave days for employees, including:
...
- Time off due to occupational accidents or occupational diseases, but the accumulated time does not exceed 6 months.
- Time off due to illness, but the accumulated time does not exceed 02 months in a year.
- Time off for maternity leave in accordance with the law on social insurance.
Thus, the time off for maternity leave in accordance with the law on social insurance is considered as a basis for determining the number of annual leave days. Therefore, the time you take maternity leave is still counted towards the annual leave days.
