Do Foreign Teachers at Secondary Schools Need to Apply for Work Permits?
Currently, there are no legal documents that stipulate the requirements for foreign teachers to teach at secondary schools. However, the school can enter into employment contracts with these teachers based on the agreement between the school, the parents, and the teachers.
According to Article 151 of the 2019 Labor Code, which specifies the conditions for foreign workers working in Vietnam, the following criteria must be met:
Foreign workers working in Vietnam are individuals holding foreign nationality and must satisfy the following conditions:
- Be at least 18 years old and possess full legal capacity;
- Have professional qualifications, technical skills, working experience, and sufficient health as stipulated by the Minister of Health;
- Not be during a period of serving a sentence, having an unexpunged conviction, or being under investigation for criminal liability according to foreign or Vietnamese law;
- Hold a work permit issued by the competent state authority of Vietnam, except for the cases specified in Article 154 of this Code.
Therefore, in the case of a teacher intending to work at your school, they must meet the above conditions, including necessarily possessing a work permit while working in Vietnam.
