Decree 73/2024/ND-CP stipulating the statutory pay rate and bonus policies for officials, public employees and armed forces, as well as the guiding documents in Vietnam
On June 30, 2024, the Government of Vietnam issued Decree 73/2024/ND-CP stipulating the statutory pay rate applicable to salary recipients and allowances, as well as bonus policies applicable to salary recipients working in agencies, organizations, and public service providers of the Vietnam Communist Party, the State, the Vietnam Fatherland Front, political-social organizations, and associations supported by the state budget for operating expenses at the central level, provincial level, district level, commune level, special administrative-economic units, and armed forces.
Decree 73/2024/ND-CP takes effect from July 1, 2024.
As of December 31, 2024, there are 03 guiding documents for Decree 73/2024/ND-CP, including:
[1] Circular 95/2024/TT-BQP guiding the implementation of bonus policies for subjects receiving salaries from the state budget within the management scope of the Ministry of Defense.
[2] Circular 62/2024/TT-BTC guiding the determination of needs, sources, and methods of expenditure to implement the statutory pay rate and bonus policies according to Decree 73/2024/ND-CP and adjusting the monthly allowance for retired commune-level officials under Decree 75/2024/ND-CP issued by the Minister of Finance.
[3] Circular 07/2024/TT-BNV guiding the implementation of the statutory pay rate for salary and allowance recipients in agencies, organizations, and public service providers of the Communist Party, the State, Vietnam Fatherland Front, political-social organizations, and associations issued by the Minister of Home Affairs.

Which objects are applicable to the statutory pay rate in Vietnam?
According to Article 2 of Decree 24/2023/ND-CP, the objects applicable to the statutory pay rate include:
- Officials from the central to district level specified in Clause 1 and Clause 2, Article 4 of Law on Officials and Civil Servants 2008 (amended and supplemented by Law on Officials, Civil Servants and Law on Public Employees, amended 2019).
- Commune-level officials specified in Clause 3, Article 4 of Law on Officials and Civil Servants 2008 (amended and supplemented by Law on Officials, Civil Servants and Law on Public Employees, amended 2019).
- Public employees in public service providers as stipulated by the Law on Public Employees 2010 (amended and supplemented by Law on Officials, Civil Servants and Law on Public Employees, amended 2019).
- Persons working under labor contract policies specified in Decree 111/2022/ND-CP of the Government of Vietnam regarding contracts for certain types of work in administrative agencies and public service providers eligible or agreed upon in the labor contract to apply salary ranking according to Decree 204/2004/ND-CP of the Government of Vietnam on salary policies for officials, public employees, and armed forces.
- Persons working within staffing norms at associations supported by state budget for operating expenses according to Decree 45/2010/ND-CP of the Government of Vietnam on the organization, operation, and management of associations (amended and supplemented by Decree 33/2012/ND-CP).
- Officers, professional soldiers, non-commissioned officers, soldiers, defense workers, public defense employees, and contracted laborers of the Vietnam People's Army.
- Officers, non-commissioned officers receiving salaries, non-commissioned officers, conscript soldiers, police officers, and contracted laborers of the People's Public Security.
- Persons working in the cipher organization.
- Individuals engaged in non-professional activities at the commune level, in villages, and in neighborhood areas.
What is the statutory pay rate in Vietnam according to Decree 73?
Based on Article 3 of Decree 73/2024/ND-CP stipulating the statutory pay rate:
Article 3. Statutory pay rate
- The statutory pay rate serves as a basis for:
a) Calculating salaries in salary tables, allowances, and implementing other policies as provided by law for the subjects specified in Article 2 of this Decree;
b) Calculating operation fees and living expenses as stipulated by law;
c) Calculating contributions and benefits based on the statutory pay rate.
- From July 1, 2024, the statutory pay rate is 2,340,000 VND/month.
