Circular 13/2024/TT-BTP stipulating the code, standards, and professional title for public employees responsible for judicial records in Vietnam
On November 25, 2024, the Minister of Justice of Vietnam promulgated Circular 13/2024/TT-BTP regulating the code and criteria for professional titles for officers responsible for judicial records in Vietnam (effective from January 15, 2025).
Circular 13/2024/TT-BTP applies to public employees working in the field of judicial records at the National Judicial Record Center under the Ministry of Justice, and other related agencies, organizations, or individuals.
According to Article 2 of Circular 13/2024/TT-BTP, the codes for professional titles for public employees responsible for judicial records in Vietnam are defined as follows:
- Judicial Record Public Employee Class I - Code: V.01.01.01.
- Judicial Record Public Employee Class II - Code: V.01.01.02.
- Judicial Record Public Employee Class III - Code: V.01.01.03.

What are the general criteria for professional titles for public employees responsible for judicial records in Vietnam?
Circular 13/2024/TT-BTP stipulates the general criteria for professional titles for public employees responsible for judicial records in Vietnam as follows:
[1] General criteria on professional ethics stipulated in Article 3 of Circular 13/2024/TT-BTP
- Have a sense of responsibility, honesty, objectivity, dedication to work; comply with the regulations and rules of the agency or unit.
- Adhere to regulations on authority, procedures, and formalities in the duties of designing, managing, protecting, utilizing the Judicial Record database, and issuing Judicial Record Certificates.
- Strictly comply with regulations concerning information safety, security, and respect for individual privacy, facilitating the request of agencies, organizations, and individuals for the issuance of Judicial Record Certificates according to legal rights and organizational regulations.
- Proactively and creatively propose solutions and initiatives in judicial record tasks.
- Other standards as prescribed by the Minister of Justice regarding professional ethics of public employees in the Judicial Sector.

- Graduate from university or higher specialization in Law.
- Possess a professional certificate of Judicial Record title in accordance with the content and program of the Ministry of Justice.
What are tasks and powers of agencies in state management of judicial records in Vietnam?
Pursuant to Article 9 of Law on Judicial Records 2009, the tasks and powers of agencies in state management of judicial records are as follows:
Article 9. Tasks and powers of agencies in state management of judicial records
- The Government of Vietnam uniformly manages the state management of judicial records.
- The Supreme People's Court and the Supreme People's Procuracy are responsible to cooperate with the Government of Vietnam in executing state management of judicial records.
- The Ministry of Justice is accountable to the Government of Vietnam for implementing state management of judicial records, with the following tasks and powers:
a) Propose competent state agencies to issue or directly issue legal documents on judicial records;
b) Direct and organize the implementation of legal documents on judicial records; disseminate and educate legal knowledge on judicial records; conduct training courses for officials working in judicial records;
c) Manage the judicial record database at the National Judicial Record Center;
d) Ensure the infrastructure and working means for the National Judicial Record Center;
e) Direct and guide professional practices in judicial records;
f) Inspect, audit, handle violations, and resolve complaints and denunciations regarding the implementation of the law on judicial records;

Thus, the tasks and powers of agencies in state management of judicial records are as follows:
- The Government of Vietnam uniformly manages the state management of judicial records.
- The Supreme People's Court and the Supreme People's Procuracy are responsible to cooperate with the Government of Vietnam in executing state management of judicial records.
- The Ministry of Justice is accountable to the Government of Vietnam for implementing state management of judicial records, with the following tasks and powers:

+ Implement information technology applications in building databases and managing judicial records;
+ Engage in international cooperation in the field of judicial records;
+ Annually report to the Government of Vietnam about judicial record management activities.
- The Ministry of Public Security, Ministry of Defense, Ministry of Foreign Affairs, and other ministries and ministerial agencies, within their tasks and powers, are responsible for cooperating with the Ministry of Justice to execute state management of judicial records.
- The People's Committee of provinces and centrally-run cities (hereinafter referred to as Provincial People's Committee) executes state management of judicial records in localities, with the following tasks and powers:
+ Direct and organize the implementation of legal documents on judicial records; disseminate and educate legal knowledge on judicial records;
+ Ensure personnel, infrastructure, and working means for judicial record management activities in localities;
+ Inspect, audit, handle violations, and resolve complaints and denunciations regarding the implementation of the law on judicial records;
+ Implement IT applications in building databases and managing judicial records as guided by the Ministry of Justice;
+ Annually report to the Ministry of Justice about judicial record management activities in localities.
