Circular 04/2024/TT-BNV provides guidance on how to determine the structure of official ranks. What is the procedure for determining the structure of official ranks? What are the new regulations on the proportion of official ranks for each specific field starting from August 15, 2024?

Circular 04/2024/TT-BNV guiding the determination of the official rank structure

On June 27, 2024, the Minister of Home Affairs issued Circular 04/2024/TT-BNV amending and supplementing a number of provisions of Circular 13/2022/TT-BNV of December 31, 2022, by the Minister of Home Affairs guiding the determination of the official rank structure.

Some prominent contents in Circular 04/2024/TT-BNV include:

- During the period of not yet implementing salary payment based on position, title according to Resolution 27-NQ/TW in 2018 of the 7th Central Conference of the 12th term on salary policy reform for officials and public employees, armed forces, and laborers in enterprises, officials holding leadership, management positions may take exams and be considered for rank promotion corresponding to the complexity of the leadership, management position but not counted into the official rank structure of the agency, organization.

- Adding regulations on:

+ The percentage of official ranks of agencies, organizations, units under, and directly under ministries, and equivalent-level agencies

+ The percentage of official ranks of specialized agencies and administrative agencies, organizations under the provincial People's Committee

+ The percentage of official ranks of specialized agencies and administrative agencies, organizations under the district People's Committee

+ The percentage of official ranks of other agencies, organizations

Procedures for determining the official rank structure

Based on Article 3 of Circular 13/2022/TT-BNV, some phrases are abolished by Clause 4, Article 1 of Circular 04/2024/TT-BNV, the procedures for determining the official rank structure are as follows:

Step 1: The head of the agency using officials determines the percentage (%) of officials holding the ranks of officials at the agency, organization, reports to the competent authority for approval.

Step 2: The head of the agency managing the officials approves the official rank structure suitable to the complexity level of the job according to the position, nature, characteristics, and scale of the agency's activities using officials.

Step 3: The department handling personnel organization of the agency, organization, unit is responsible for advising, assisting the head in determining the number of official ranks and the official rank structure of the agency, organization, unit to submit to the competent authority for consideration and decision.

New regulations on the percentage of official ranks by specific sectors effective from August 15, 2024

In Articles 2a, 2b, 2c, and 2d of Circular 13/2022/TT-BNV, supplemented by Clause 2, Article 1 of Circular 04/2024/TT-BNV, which takes effect from August 15, 2024, the percentage of official ranks by specific sectors is added as follows:

(1) The percentage of official ranks of agencies, organizations, units under, and directly under ministries, equivalent-level agencies:

- For departmental-level organizations and equivalent under, directly under ministries, and equivalent-level agencies:

+ Senior specialist rank and equivalent: Maximum 40%;

+ Principal specialist rank and equivalent: Maximum 40%;

+ Specialist rank and equivalent, officer and equivalent, employee and equivalent: The remaining percentage of ranks.

- For organizations under and directly under the general department:

+ For departmental-level organizations and equivalent under the general department

+ Senior specialist rank and equivalent: Maximum 30%;

+ Principal specialist rank and equivalent: Maximum 50%;

+ Specialist rank and equivalent, officer and equivalent, employee and equivalent: The remaining % of ranks.

- For organizations directly under the general department established locally by sector:

+ Principal specialist rank and equivalent: Maximum 40%;

+ Specialist rank and equivalent, officer and equivalent, employee and equivalent: The remaining % of ranks.

(2) The percentage of official ranks of specialized agencies and administrative agencies, organizations under the provincial people's committee

- For specialized agencies and administrative agencies, organizations under the centrally governed city:

+ Principal specialist rank and equivalent: Maximum 50%;

+ Specialist rank and equivalent, officer and equivalent, employee and equivalent: The remaining % of ranks.

- For specialized agencies and administrative agencies, organizations under the centrally governed province:

+ Principal specialist rank and equivalent: Maximum 40%;

+ Specialist rank and equivalent, officer and equivalent, employee and equivalent: The remaining % of ranks.

(3) The percentage of official ranks of specialized agencies and administrative agencies, organizations under the district people's committee

Officials from specialized agencies and administrative agencies, organizations under the district people's committee holding specialist and equivalent ranks, officer and equivalent, employee and equivalent ranks suitable to the standards and conditions of the job position.

(4) The percentage of official ranks of other agencies, organizations

For agencies, organizations established according to the Communist Party regulations, laws, assigned staff by competent authorities but not within the subjects in (1), (2), (3) above, the head of the agency managing the officials decides to apply the percentage of official ranks stipulated in (1), (2), (3) suitable to the functions, duties, and scale of the agency's activities using officials.
