Can the Director of a Company Simultaneously be the Chairman of the Trade Union at the Establishment?
Section 4.3, Article 4 of Guidance 238/HD-TLD in 2014 stipulates:
4.3. The cases in which individuals cannot concurrently hold the position of trade union president include: Trade union members who hold positions such as chairman of the board of directors, chairman of the members' council, company president, general director, director in enterprises, and heads of administrative agencies, public service providers in the state sector are not allowed to concurrently hold the position of trade union president at the same level.
According to the above regulation, directors in enterprises are not allowed to concurrently hold the position of trade union president, therefore, the director of your company cannot simultaneously serve as the president of the grassroots trade union.
