Can the Company Terminate the Probationary Employee Before the End of the Probationary Period?
Question:
According to the regulations, can the company terminate an employee on probation before the probation period ends? Which document stipulates this? Hoping for an early response. In Article 27 of the Labor Code 2019, it is stipulated:
- At the end of the probation period, the employer must inform the employee of the probation results.
If the probation is successful, the employer shall continue to perform the labor contract that was concluded in cases where the probation agreement is included in the labor contract or must conclude a labor contract if the probation contract was concluded separately.
If the probation does not meet the requirements, the labor contract that was concluded or the probation contract shall be terminated.
- During the probation period, each party has the right to terminate the probation contract or the concluded labor contract without prior notice and without compensation.
=> Hence, according to the aforementioned regulations, during the probation period, the parties have the right to unilaterally terminate the probation contract without prior notice. Therefore, before the end of the probation period, the company has the right to terminate the employment relationship with the probationary employee.
Sincerely.
