Can Employees View Their Company’s Business License?
Based on the provisions in Clause 1, Article 5 of the Labor Code 2012 regarding the rights of employees as follows:
- To work, freely choose employment, occupation, vocational training, and to improve professional skills without discrimination;
- To receive wages corresponding to their professional skills based on an agreement with the employer; to be protected in terms of labor safety, hygiene, and to work under conditions ensuring labor safety and hygiene; to rest according to policies, have annual paid leave, and enjoy collective welfare benefits;
- To establish, join, and operate trade unions, professional organizations, and other organizations as prescribed by law; to request and participate in dialogues with the employer, implement democratic regulations, and be consulted at the workplace to protect their lawful rights and interests; to participate in management under the employer's rules;
- To unilaterally terminate the labor contract according to the provisions of law;
- To strike.
And according to the provisions in Clause 2, Article 6 of the Labor Code 2012 regarding the obligations of employers, employers have the following obligations:
- To implement labor contracts, collective labor agreements, and other agreements with employees, and to respect the honor and dignity of employees;
- To establish mechanisms and conduct dialogues with the collective workforce at the enterprise and strictly implement the grassroots democratic regulations;
- To maintain labor management records, wage books and present them upon request by competent authorities;
- To report the use of labor within 30 days from the start of operations and periodically report changes in labor conditions to local state labor management agencies during operations;
- To comply with other provisions of labor laws, social insurance laws, and health insurance laws.
According to the above provisions, the employer has no obligation to allow employees to view the company’s business license, and this is not mentioned in the employees' rights either.
