Can employees staying at the Commune Health Station receive a Certificate of leave to enjoy social insurance benefits in Vietnam?
Pursuant to Section 2 of Official Dispatch 376/BHXH-CSXH 2023 on adjusting dossiers for one-time social insurance benefits in cases of life-threatening diseases, there are provisions as follows:
1. Dossier for one-time social insurance benefits for cases of life-threatening illness specified in Point c, Clause 1, Article 60 of the Law on Social Insurance, guided in section a4, Point 1.2.3, Clause 1, Article 6, Decision No. 166/ Decision-XHH is adjusted as follows:
In case you are suffering from one of the life-threatening diseases such as cancer, polio, cirrhosis, ascites, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS: Documents must be originals or valid copies of discharge notes or summary of medical records showing the above illness.
In case of suffering from other diseases and receiving one-time social insurance benefits: The dossier is a medical examination record that must clearly conclude the contents of diseases and disabilities that reduce working capacity by 81% or more and do not control or cannot independently perform activities serving personal daily living needs that require complete supervision, assistance, and care.
2. In case the employee stays at the Commune Health Station, a Certificate of leave to enjoy social insurance and provincial social insurance is issued based on the provisions in Point b, Clause 5, Article 4 of Circular No. 39/2018/TT-BYT dated March 30. /November 2018 of the Ministry of Health for implementation.

What are regulations on medical service prices at the Commune Health Station with patient beds in Vietnam?
According to Clause 5, Article 4, Circular 39/2018/TT-BYT stipulates service prices at Commune Health Stations as follows:
Rules for application of medical service prices in medical facilities contracted to provide medical services covered by health insurance
1. For institutes with patient beds, medical centers providing medical services that are licensed to serve functions of hospitals, classed medical centers in districts providing medical services, apply the prices by hospital of the same class.
2. For health protection and care clinics for public officials in provinces, cities not affiliated to general hospitals in provinces and cities, apply the prices issued by class II hospitals.
3. For unclassed medical facilities, army medical clinics, civil-military medical clinics, military infirmaries, infirmaries, private polyclinics and specialty clinics, apply the prices issued by class IV hospitals.
4. For regional polyclinics:
a. If licensed to serve functions of hospitals or fall into the cases specified in clause 12, Article 11 of the Government’s Decree No. 155/2018/ND-CP dated November 12, 2018 on amendments to certain articles related to the business and investment conditions under state management of the Ministry of Health, apply the prices issued by class IV hospitals;
b. If only providing emergency medical response and medical services for outpatients, apply the prices issued by class IV hospitals. If permitted by the Department of Health to have patient beds, the price for an outpatient bed shall be equal to 50% of the price for hospital stay of type 3 inpatient bed of class IV hospitals. An outpatient can only be confined to a bed for maximum 3 days for each medical treatment. Payment for medical examination service is not required if the price for outpatient bed is paid.
5. For medical aid stations in communes and towns, medical aid stations in companies, agencies, organizations, schools and civil-military medical aid stations:
a. Apply the medical service prices issued by the medical aid stations in communes. Apply the medical procedure price that is equal to 70% of such price specified in Appendix III.
b. If having patient beds as decided by the Health Department, apply the price which is equal to 50% of the price for hospital stay of type 3 inpatient bed issued by class IV hospitals. An outpatient can only be confined to a bed for maximum 3 days for each medical treatment. Payment for medical examination service is not required if the price for outpatient bed in commune medical aid stations is paid.

Thus, the service price at the Commune Health Station with patient beds is equal to 50% of the daily price for a class 3 internal medicine bed of a class IV hospital in Vietnam.
The maximum number of paid days is 03 days/person/treatment period. Do not pay for medical examination in case you have paid for a patient bed at the commune health station in Vietnam.
Who has authority to issue discharge notes to employees staying at the commune health station in Vietnam?
Pursuant to Clause 1, Article 15 of Circular 56/2017/TT-BYT stipulating issuance of discharge notes as follows:
Issuance of discharge notes
1. Authority to issue discharge notes: Licensed health facilities providing inpatient treatment.
2. The discharge note template is provided in Annex 3 enclosed herewith.
3. If the patient stays at a commune-level Health station as specified in Point a Clause 4 Article 7 No. 41/2014/TTLT-BYT-BTC dated November 24, 2014 of the Ministry of Health and the Ministry of Finance guiding health insurance, the health station may issue a discharge note in accordance with the template specified in Annex 3 enclosed herewith when the patient is discharged from the health station.
According to the above regulations in Vietnam, the commune health station has the authority to issue hospital discharge notes to employees treated at the commune health station.
