Can Doctors Working at Hospitals Open Private Clinics?
In Article 12 of Decree 109/2016/ND-CP on the issuance of practicing certificates for practitioners and operating licenses for medical examination and treatment facilities, the following stipulations are provided:
Article 12. Principles of registering to practice
Practitioners at medical examination and treatment facilities are allowed to register as the person responsible for technical specialties at one medical examination and treatment facility outside of working hours.
Practitioners at state medical examination and treatment facilities are not allowed to register as the head of private hospitals or medical examination and treatment facilities established and operated under the Enterprise Law or Cooperative Law, except in cases where they are appointed by competent state authorities to participate in managing and operating a medical examination and treatment facility with state capital investment.
Practitioners who have registered as the person responsible for technical specialties at one medical examination and treatment facility are allowed to register to practice outside working hours at another medical examination and treatment facility.
=> Based on the above regulations, doctors working at medical examination and treatment facilities are not allowed to register as the head of private hospitals or medical examination and treatment facilities established and operated under the Enterprise Law or Cooperative Law, except in cases where they are appointed by competent state authorities to participate in managing and operating a medical examination and treatment facility with state capital investment.
