Can 14 years and 11 months be rounded up to 15 years of heavy labor for early retirement?
Point a Clause 1 Article 5 of Decree 135/2020/ND-CP stipulates:
Retirement at an age lower than the normal retirement age under usual working conditions for employees as specified in Clause 3 Article 169 of the Labor Code is detailed as follows:
- Employees in the following cases may retire at an age lower but not more than 5 years younger than the retirement age stipulated in Article 4 of this Decree at the time of retirement, unless otherwise provided by law:
a) Employees who have at least 15 years of working in heavy, hazardous, dangerous occupations or particularly heavy, hazardous, dangerous occupations listed by the Ministry of Labor - Invalids and Social Affairs.

According to this provision, you must have worked in heavy, hazardous, dangerous occupations for at least 15 years to retire at an age lower than the normal retirement age (not more than 5 years younger than stipulated). This Decree does not provide any case where the number of years of work is reduced. Therefore, in this case, you do not meet the conditions regarding the number of years of hazardous, dangerous work to qualify for early retirement.
