Are legal counselors in the Trade Union entitled to transportation allowances?
Are officials engaged in legal consulting within the Trade Union entitled to travel reimbursement?
Based on Point b Item 1.1 Clause 1 Article 4 of the Regulation on standards, the expenditure norms in Trade Union agencies issued together with Decision 4291/QD-TLD in 2022 covering direct legal consulting activities and other forms of legal consulting are as follows:
b) Expenditures for direct legal consulting activities and other forms of legal consulting:
- Expenditures for meetings and workshops discussing consultancy cases;
- Expenditures for travel, fuel support, and public transportation for officials engaged in legal consulting activities;
- Remuneration for report writing and case analysis: maximum of 500,000 VND per person per case;
- Phone allowance for legal consultants: 200,000 VND per person per month;
- Other expenditures suitable to the reality and regulations of the General Federation;
- Expenditures for allowances and remunerations for reporters and collaborators for subjects who are not trade union officials. In cases of trade union officials, the head of the agency shall decide based on the financial situation.
Thus, you, as a legal consultant, will be reimbursed for travel expenses, including fuel support and public transportation costs, for the purpose of performing legal consulting duties.
How are expenditures for mobile legal consulting activities on labor and trade unions managed?
According to Point a Item 1.1 Clause 1 Article 4 of the Regulation on standards, the expenditure norms in Trade Union agencies issued together with Decision 4291/QD-TLD in 2022 covering expenditures for labor and mobile trade union legal consulting activities are as follows:
a) Expenditures for mobile labor and trade union legal consulting:
- Venue rental;
- Support for drinking water and meals for workers: maximum of 40,000 VND per person per session;
- Rewards for workers participating in answering questions: 30,000 VND to 50,000 VND per person per reward;
- Remunerations for invited reporters and collaborators for mobile consultations; writing Q&A content, scenarios... The remuneration for reporters and collaborators shall be in accordance with Point 2.4 Clause 2, Point 7.4 Clause 7 Article 4 of this Regulation;
- Printing of materials distributed to workers;
- Overtime pay for union officials participating in mobile consultation sessions, support for fuel, and public transportation...
