Appendix on Extension Agreement for Contracts Signed Before 2021: Are They Still Valid?
Article 22 of the Labor Code 2019 stipulates:
An appendix to a labor contract is a part of the labor contract and has the same effect as the labor contract.
The appendix to the labor contract details, amends, and supplements certain articles and clauses of the labor contract but does not amend the term of the labor contract.
In case the appendix to the labor contract details certain articles and clauses of the labor contract leading to a different interpretation from the labor contract, the contents of the labor contract shall prevail.
In case the appendix to the labor contract amends and supplements certain articles and clauses of the labor contract, it must clearly state the amended and supplemented contents and the effective date.
Thus, according to this regulation, as of January 01, 2021, the term of the labor contract cannot be amended. Appendices signed before that date are still valid until they expire as stipulated in the appendix.
