Article 5. Control through systems, means, devices, databases regarding road traffic order and safety

- Control through the use of operational technical equipment, smart devices supporting the command and control of road traffic; utilizing data from journey monitoring devices, devices recording driver images, databases regarding road traffic order and safety.
a) Traffic Police units use operational technical equipment (including operational technical devices for inspecting load of motor vehicles), smart devices supporting the command and control of road traffic; utilizing data from journey monitoring devices, devices recording driver images, databases regarding road traffic order and safety to control, detect, and handle legal violations related to road traffic order and safety, and other legal violations as regulated;
b) Results, data collected from means, devices, databases provided for in point a of this clause shall be used to detect and handle violations in compliance with the legal provisions on administrative violation handling, Decree No. 135/2021/ND-CP, which regulates standards, management, operation, use of the Journey Monitoring Devices Management System, devices recording driver images, and other related legal provisions;
c) The procedures for detection and handling of results collected from means, devices, databases provided for in point a of this clause are executed as per the provisions in Article 15 and Article 24 of this Circular.

What are requirements must be ensured when traffic police in Vietnam stop and control vehicles?
Pursuant to Clause 2, Article 12 of Circular 73/2024/TT-BCA regulating stopping vehicles participating in road traffic for control:
Article 12. Stopping Vehicles Participating in Road Traffic for Control
- Traffic Police officers performing patrol and control duties as planned may stop vehicles participating in road traffic for control as per the provisions in Article 65, Article 66 of the Road Traffic Order and Safety Law.
2. The stopping and control of vehicles must ensure the following requirements:
a) Safety, compliance with legal regulations, without causing obstruction to traffic activities;
b) Once a vehicle is stopped, control and violation handling (if any) must be conducted as regulated.
- When controlling at a point on the traffic road or at a Traffic Police Station, requirements specified in Clause 2, Article 6, Clause 2 of this Article, and the following requirements must be ensured:
a) Set up barriers using cone-shaped markers or ropes running along the direction of the road on the road section, lane close to the shoulder or sidewalk to form the duty execution area as per the Ministry of Public Security's regulations on implementing democracy in traffic order and safety assurance. Based on the practical situation, characteristics of the traffic road to deploy barrier length suitably, ensuring safety;

Who are included in the patrol and control force in Vietnam?
Pursuant to Article 65 of the Road Traffic Order and Safety Law 2024 regulating the patrol and control force:
- Traffic Police force
- Other forces, units within the People's Public Security mobilized to cooperate with Traffic Police in performing patrol and control duties as needed based on the tasks, powers of the mobilized force as regulated by law, decision of the competent authority, and in conformity with the practical task.
