Who is Required to Wear Helmets When Participating in Traffic?
Clause 2, Article 30 of the 2008 Road Traffic Law stipulates:
The operator and passengers on two-wheeled motorcycles, three-wheeled motorcycles, and mopeds must wear helmets with properly fastened chin straps.
According to Decree 100/2019/ND-CP, the following individuals are required to wear helmets while participating in traffic:
- Operators of motorcycles and mopeds;
- Operators of motorized bicycles and electric bicycles;
- Passengers on motorcycles, mopeds, electric motorcycles, similar types of motorcycles, similar types of mopeds, motorized bicycles, and electric bicycles.
Thus, there are three groups of individuals who must wear helmets with properly fastened chin straps while participating in traffic. If the chin strap is not properly fastened, it will be penalized similarly to not wearing a helmet.
Note there are three cases where penalties will not be applied:
- Transporting a sick person for emergency treatment;
- Transporting children under 06 years old;
- Escorting individuals who have committed legal violations.
