Who are eligible for issuance of driver licenses with unlimited validity in Vietnam?

Pursuant to Article 59 of the Law on Road Traffic in 2008 stipulating driver licenses:

Driver licenses

1. Depending on types, engine capacity, mass and utilities of motor vehicles, driver licenses are classified into driver licenses with unlimited validity and driver licenses with limited validity.

2. Driver licenses with unlimited validity are of the following categories:

a/ Category A1, granted to drivers of motorcycles with a cylinder capacity of between 50 cm3 and under 175 cm3;

b/ Category A2, granted to drivers of motorcycles with a cylinder capacity of 175 cm3 or higher and those prescribed for category-A1 driver licenses;

c/ Category A3, granted to drivers of three-wheeled motor vehicles and those prescribed for category-A1 driver licenses and similar vehicles.

3. Disabled people operating three-wheeled motor vehicles designed for them shall be granted category-A1 driver licenses.

As regulated above, driver licenses with unlimited validity in Vietnam are issued for following entities:

- Category A1, granted to drivers of motorcycles with a cylinder capacity of between 50 cm3 and under 175 cm3;

- Category A2, granted to drivers of motorcycles with a cylinder capacity of 175 cm3 or higher and those prescribed for category-A1 driver licenses;

- Category A3, granted to drivers of three-wheeled motor vehicles and those prescribed for category-A1 driver licenses and similar vehicles.

What are cases of revocation of a driver license in Vietnam from 01/6/2024?

Pursuant to Clause 13 Article 33 of the Circular 12/2017/TT-BGTVT (amended by Point b, Clause 24, Article 4 of the Circular 05/2024/TT-BGTVT) stipulating use and management of driver licenses:

14. A driver license shall be revoked in the following cases:

a) The driver commits deceptive acts in order to be eligible for issuance of the driver license;

b) The driver erases or falsifies information printed on the driver license;

c) The driver allows another person to use his/her driver license;

d) The competent authority issues the driver license to an ineligible person;

dd) There are errors in pieces of information on full name, date of birth, nationality, place of residence, driver license class, date of expiry, date of issuance, signatory;

e) Through health examination, the competent authority confirms that the driver uses narcotic (except for violations specified in point c and point d Clause 10 Article 5; point h and point I Clause 8 Article 6 of Decree No. 100/2019/ND-CP dated December 30, 2019).

As regulated above, from 01/6/2024, there will be 06 cases of revocation of a driver license in Vietnam:

- Case 1: The driver commits deceptive acts in order to be eligible for issuance of the driver license;

- Case 2: The driver erases or falsifies information printed on the driver license;

- Case 3: The driver allows another person to use his/her driver license;

- Case 4: The competent authority issues the driver license to an ineligible person;

What is the age of a driver in Vietnam?

Pursuant to Clause 1 Article 60 of the Law on Road Traffic in 2008 stipulating age of drivers:

- Persons aged full 16 years or older may drive mopeds with a cylinder capacity of under 50 cm3;

- Persons aged full 18 years or older may drive motorcycles, three-wheeled motor vehicles with a cylinder capacity of 50 cm3 or higher and vehicles with similar structure; trucks, tractors with a mass of under 3,500 kg; passenger cars of up to 9 seats;

- Persons aged full 21 years or older may drive trucks, tractors with a mass of 3,500 kg or more; category-B2 vehicles pulling trailers (FB2);

- Persons aged full 24 years or older may drive passenger cars of between 10 and 30 seals; category-C vehicles pulling trailers or semi-trailers (FC);

- Persons aged full 27 years or older may drive passenger cars of over 30 seals; category-D vehicles pulling trailers (FD);

- The maximum age of drivers of 30 seat-plus passenger cars is 50 for women and 55 for men.
