Which violations lead to the revocation of a driver license for motorcycles in 2025 in Vietnam?

Based on Clause 12, Article 7 of Decree 168/2024/ND-CP regulating sanctions, point deduction for licenses of operators of motorcycles, mopeds, equivalents to motorcycles, and equivalents to mopeds violating road traffic rules:

Article 7. Sanctions, Point Deduction for Licenses of Operators of Motorcycles, Mopeds, and Similar Vehicles Violating Road Traffic Rules

  1. Besides being subject to the main penalty, the vehicle operator committing the violation will also be subject to the following supplementary penalties:

a) Committing the act specified at Point d, Clause 2 of this Article will result in the confiscation of priority signal devices installed or used contrary to regulations;

b) Committing acts specified at Points a, b, h, i, k of Clause 9 of this Article will result in revocation of the driver license from 10 to 12 months;

c) Committing acts specified at Points d, dd, e, g of Clause 9; Clause 11 of this Article will result in revocation of the driver license from 22 to 24 months.

Violations leading to the revocation of driver licenses for motorcycles include:

[1] Revocation of driver license for 10 to 12 months

- Operating a vehicle recklessly on roads; using a kickstand or other object to scrape the road while the vehicle is in motion

- Operating a vehicle in a group of two or more that exceeds the speed limit

- Sitting behind and using arms to reach around the person in front to control the vehicle, except when accompanying a child under 6 years of age sitting in front

- Operating a vehicle in a convoy that obstructs traffic, unless authorized by a competent authority

- Using horns or continuously revving the engine (revving up) in densely populated areas, or near medical facilities, except for priority vehicles on duty.

[2] Revocation of driver license for 22 to 24 months

- Operating a vehicle on the road with a blood alcohol concentration or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath

- Not complying with alcohol concentration tests requested by law enforcement officers

- Operating a vehicle on the road with drugs or other substances prohibited by law in the body

- Not complying with tests for drugs or other prohibited substances required by law enforcement officers

- Releasing both hands while driving; using feet to operate the vehicle; sitting sideways while driving; lying on the seat while driving; switching drivers while the vehicle is in motion; turning around to drive or covering eyes to drive

- Operating a two-wheeled vehicle on one wheel, or a three-wheeled vehicle on two wheels

- Repeated offenses involving reckless driving

How to determine the point of driver license in Vietnam when it is reissued?

According to Article 58 of the Law on Road Traffic Order and Safety 2024 on points for driver licenses:

Article 58. Points for driver licenses

[...]

  1. If a driver license's points are completely deducted, the holder of the driver license is not allowed to operate road vehicles according to that license. After at least 6 months from the date the points are completely deducted, the license holder may participate in a legal knowledge test on road traffic order and safety as regulated in Clause 7, Article 61 of this Law organized by the Traffic Police; if the test is passed, 12 points are restored.

4. A driver license, after being exchanged, reissued, or upgraded, retains the same points as the license before the exchange, reissue, or upgrade.

  1. Persons authorized to impose administrative penalties have the authority to deduct points from driver licenses.
  1. The Government of Vietnam specifies details for Clause 1 of this Article; specifies the process, procedure, authority to deduct points, restore points of driver licenses; specifies the roadmap for implementing this Article. The Minister of Public Security specifies details for Clause 3 of this Article.

According to the above regulation, a driver license after reissuance retains the same points as before the upgrade.

What are prohibited acts in road traffic order and safety in Vietnam?

Based on Article 9 of the Law on Road Traffic Order and Safety 2024, the prohibited acts in road traffic order and safety are as follows:

- Operating motorized vehicles on the road without a driver license as prescribed by law; operating a specialized motor vehicle on the road without a driver license or certificate of refresher training on road traffic law, or a certificate for operating a specialized motor vehicle.

- Operating vehicles on the road with alcohol in the blood or breath.

- Operating vehicles on the road with drugs or other substances prohibited by law in the body.

- Insulting, threatening, obstructing, resisting, or failing to comply with orders, directions, requests for inspection, and control of law enforcement officers ensuring road traffic order and safety.

- Racing, organizing races, inciting, assisting, or encouraging illegal racing; operating vehicles on the road causing erratic behavior, repeatedly revving engines.

- Holding and using a phone or other electronic device while operating a vehicle moving on the road.

- Allowing motor vehicles, specialized motor vehicles to be operated by individuals not meeting the legal conditions to participate in road traffic.

- Operating motor vehicles, specialized motor vehicles not meeting legal standards for technical safety and environmental protection, or vehicles not legally eligible for road traffic participation.

- Importing, manufacturing, assembling motor vehicles, specialized motor vehicles not complying with legal standards for technical safety and environmental protection.

- Illegally altering other types of vehicles into passenger vehicles, except for transformation into passenger vehicles for national defense or security purposes.

- Illegally altering; intentionally tampering with odometer readings of vehicles; cutting, welding, erasing, chiseling, illegitimately re-stamping chassis numbers, engine numbers of motor vehicles, specialized motor vehicles.

- Intentionally interfering with, changing the control software of vehicles or engines registered with management authorities to falsify inspection, testing, or certification results; renting or borrowing motor vehicle parts solely for inspection purposes.

- Transporting goods exceeding total weight, axle load, dimensions allowed by vehicle or exceeding load and dimensions permitted by roads without obtaining management agency approvals or not meeting legal requirements; transporting goods requiring securing but failing to secure or improperly securing as required by law; carrying more passengers than legally permitted.

- Transporting prohibited goods, undertaking illegal transportations, or not fully complying with legal regulations on transporting hazardous materials or wildlife.

- Threatening, insulting, competing, luring passengers; threatening or coercing passengers into using unsolicited services; transferring, offloading passengers or engaging in other actions to evade detection for overloading or carrying excessive passengers according to legal provisions.

- Installing or using sound and light equipment on motor vehicles, specialized motor vehicles that disrupt road traffic order and safety.

- Illegally producing, using, buying or selling vehicle plates; operating motor vehicles, specialized motor vehicles with number plates not issued by competent state authorities, incorrect vehicle number plate positions; bending, covering number plates; altering or modifying numbers, letters, color, shape, size of number plates.

- Interfering with or falsifying data from journey monitoring devices, cameras installed on vehicles as per regulations.

- Destroying, damaging, rendering traffic control, surveillance devices, or intelligent road traffic management aids ineffective.

- Placing, putting unauthorized obstacles or impediments on roads; scattering sharp objects, discharging slipper-causing materials on roads; dropping, spreading soil, stones, goods, construction materials, waste on roads; discharging or spilling chemicals, waste causing road traffic safety hazards.

- Obstructing individuals or vehicles on the road; throwing bricks, earth, stones, sand, or other objects at people or vehicles on the road.

- Exploiting, abusing road traffic safety, order tasks to engage in law violations, harassment, infringing upon State interests, legal rights, and interests of organizations and individuals.

- Exploiting one's or another's position, power, profession to violate road traffic order and safety laws or interfering with, impacting the process of law violation handling regarding road traffic order and safety.

- Using priority vehicle rights when not performing tasks according to legal provisions; installing, using priority signal devices noncompliant with law.

- Failing to report, falsely reporting, or providing inaccurate information to evade responsibility upon detection of violations of road traffic order and safety laws.

- Fleeing after causing a road traffic accident to evade responsibility; intentionally not assisting road accident victims when possible; infringing upon the life, health, or property of victims, perpetrators, or assisting individuals in road traffic accidents; exploiting road traffic accidents to assault, threaten, incite, pressure, disrupt, obstruct road traffic accident handling.

- Operating flying objects, unmanned aircraft, ultralight vehicles within road boundaries causing obstruction or safety risks for road traffic participants, except for legally authorized unmanned aircraft, ultralight vehicles.

- Other acts violating road traffic rules.
