How to handle the case where only one person participates in the license plate auction in Vietnam?

According to Article 37 of the Law on Road Traffic Order and Safety 2024, which stipulates license plate auctions:

Article 37. License Plate Auction

1. The license plates put up for auction include those for cars, motorbikes, and mopeds as specified in point c and point d, clause 2, Article 36 of this Law, and are disclosed for organizations and individuals to choose and register for participation in the auction. License plates not chosen for registration in the auction by any organization or individual will be transferred to the vehicle registration and management system for registration according to the provisions of law.

2. The starting price for a car license plate put up for auction is no less than 40 million VND; the starting price for a motorbike or moped license plate put up for auction is no less than 5 million VND.

3. The upfront deposit is not less than the starting price of the type of license plate put up for auction.

4. When the registration period for participation in the auction ends, if only one person registers to participate in the auction, or if multiple people register but only one person participates in the auction, or if multiple people participate but only one person offers a price at least equal to the starting price of a license plate put up for auction, that person is determined to be the winner for the license plate.

What are the rights for the winner for a license plate in Vietnam?

Based on clause 1, Article 38 of the Law on Road Traffic Order and Safety 2024, the rights of the winner for a license plate are stipulated as follows:

- Receive a decision confirming the auction-winning license plate after full payment of the auction amount.

- Register the auction-winning license plate attached to the vehicle owned by them at the Police Department managing the auction-winning license plate or at their residence, temporary residence, or the headquarters of the auction-winning organization.

- Transfer, exchange, gift, or bequeath the vehicle with the auction-winning license plate.

- Within 30 days from the date of receiving a notification of the auction result, if a decision confirming the auction-winning license plate is not yet issued and the auction winner dies, the auction result is canceled, and the heir according to the legal provisions on inheritance will receive the full auction amount that the winner has paid.

- Within 12 months from the date of being issued the decision confirming the auction-winning license plate, if the auction winner dies but has not completed the vehicle registration procedures to attach the auction-winning license plate, the auction result is canceled, and the heir according to the legal provisions on inheritance will receive the full auction amount that the winner has paid.
