What is an aviation employee?
Based on Clause 1, Article 68 of the Vietnam Civil Aviation Law 2006, the regulation is as follows:
Airline employees are those who are directly involved in ensuring aviation safety, aviation security, aircraft operation, air transport, flight activities, possess appropriate licenses, and professional certificates issued or recognized by the Ministry of Transport.
- Airline employees must sign a written labor contract with the employing organization.
- Airline employees are entitled to benefits and are obliged to perform the terms stated in the labor contract and labor law.
The above is the definition of airline employees according to the regulations of aviation civil law.
At Article 10 in Circular 10/2018/TT-BGTVT, the conditions for issuing the airline employee license are stipulated as follows:
- Conditions for issuing an airline employee license:
+ Meet the standards specified in Article 8 of this Circular;
+ Attend and satisfy the requirements of the examination for the issuance of the license and the qualification rating for airline employees by the Civil Aviation Authority of Vietnam.
- The airline employee license includes the following contents:
+ The national emblem of the Socialist Republic of Vietnam;
+ Licensing authority;
+ License name;
+ License number;
+ Date of issuance, validity period (if any);
+ Full name, date of birth, place of birth, address, nationality of the licensee;
+ Qualification rating;
+ Signature of the licensee and stamp of the licensing authority;
+ A photograph of the licensee affixed with a seal;
+ Other requirements as stipulated in the specialized aviation legal documents.
- The airline employee titles listed in Clauses 1, 2, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, and 14 of Article 6 of this Circular must carry a valid airline employee license while performing their duties.
