What are the fines for allowing a person, who does not have driver license in Vietnam, to operate the vehicle on public roads? Is it compulsory to undergo training for driver license upgrading in Vietnam?

Pursuant to Clause 5 Article 30 of the Decree 100/2019/ND-CP (amended by Clause 17 Article 2 of the Decree 123/2021/ND-CP) stipulating the fines for allowing a person, who does not have driver license in Vietnam, to operate the vehicle on public roads:

Penalties imposed upon vehicle owners

5. For owners of mopeds and motorcycles: A fine ranging from VND 800,000 to VND 2,000,000 shall be imposed upon an individual, from VND 1,600,000 to VND 4,000,000 upon an organization that commits any of the following violations:

a) Deliberately cutting, welding and punching to modify chassis number and engine number; operating vehicles whose chassis number and engine number have been modified due to being cut, welded and punched;

b) Falsifying or forging the documents about vehicle registration;

c) Changing the chassis, engine, shape, size, or functions of the vehicle;

d) Providing false information or using fraudulent documents to apply for the license plate or Certificate of vehicle registration;

dd) Allowing an unqualified person according to Clause 1 Article 58 of the Law on Road traffic to operate the vehicle on public roads (including those using an expired driving license or those with revoked driving license);

e) Failure to comply with revocation of certificates of vehicle registration and license plates as per the law;

g) Operating a vehicle without the certificate of vehicle registration or with an expired certificate of vehicle registration; failure to operate a vehicle with the certificate of temporary vehicle registration within the permitted time limit or failure to operate a vehicle with restricted operation areas on the permitted routes or within the permitted areas;

As regulated above, a fine ranging from VND 800,000 to VND 2,000,000 shall be imposed upon an individual for allowing a person, who does not have driver license in Vietnam, to operate the vehicle on public roads.

Note: The above penalty are imposed on individuals. For organization, the fine for the same violation shall be from VND 1,600,000 to VND 4,000,000.

Is it compulsory to undergo training for driver license upgrading in Vietnam?

Pursuant to Article 61 of the Law on Road Traffic in 2008 stipulating driver training, examination to grant driver licenses:

Driver training, examination to grant driver licenses

1. Driver training establishments are categorized as job training establishments, must meet all adequate conditions on classrooms, driving practice grounds and vehicles, driving instructors, course books and teaching materials and possess a license as prescribed.

2. Driver training establishments must comply with the contents and programs prescribed for each kind and category of driver license.

3. Persons who wish to have driver licenses of categories A1, A2, A3, A4 and B1 must be trained. Persons who wish to have driver licenses of categories B2, C, D, E and driver licenses of category F must be trained on a full-time basis at training establishments.

4. Training for driver license upgrading shall be conducted for the following cases:

a/ Upgrading driver licenses from category B1 to B2;

b/ Upgrading driver licenses from category B2 to C or D;

c/ Upgrading driver licenses from category C to D or E;

d/ Upgrading driver licenses from category D to E;

e/ Upgrading driver licenses from category B2, C, D or E to categories of driver licenses for corresponding vehicles with trailers or semi-trailers.

As regulated above, training for driver license upgrading shall be conducted for the following cases:

- Upgrading driver licenses from category B1 to B2;

- Upgrading driver licenses from category B2 to C or D;

- Upgrading driver licenses from category C to D or E;

- Upgrading driver licenses from category D to E;

- Upgrading driver licenses from category B2, C, D or E to categories of driver licenses for corresponding vehicles with trailers or semi-trailers.

What are types of driver licenses in Vietnam?

Pursuant to Article 16 of the Circular 12/2017/TT-BGTVT stipulating classification of driver licenses:

Classification of driver licenses

1. A1 class licenses issued to:

a) Persons controlling two-wheeled motorbikes with cylinder volume from 50 cm3 to less than 175 cm3;

b) Disabled controlling motor tricycles intended for the disabled.

2. A2 class licenses issued to persons controlling two-wheeled motorbikes with cylinder volume from 175 to cm3 and over and other types of vehicles intended for A1 class.

3. A3 class licenses issued to persons controlling motor tricycles, vehicles intended for A1 class and similar vehicles.

4. A4 class licenses issued to persons controlling small tractors with loading capacity up to 1,000 kg.

5. B1 class (automatic transmission) issued to persons who do not practice as a driver for controlling following types of cars:

a) Automatic transmission 9-seat cars including driver seat;

b) Trucks, including special trucks (automatic transmission) with design loading capacity less than 3.500 kg;

c) Cars intended for the disabled.

6. B1 class licenses issued to persons who do not practice as a driver for controlling following types of cars:

a) 9-seat cars including driver seat;

b) Trucks, including special trucks with design loading capacity less than 3.500 kg;

c) Tractors hauling a trailer with design loading capacity less than 3,500 kg.

7. B2 class licenses issued to persons who practice as a driver for controlling following types of cars:

a) Special cars with design loading capacity less than 3.500 kg;

b) Cars intended for B1 class.

8. C class licenses issued to drivers controlling following types of cars:

a) Trucks, including special trucks with design loading capacity from 3.500 kg and over;

b) Tractors hauling a trailer with design loading capacity from 3,500 kg and over;

c) Cars intended for B1 and B2 classes.

9. D class licenses issued to drivers controlling following types of cars:

a) 10 to 30-seat cars including driver seat;

b) Cars intended for B1, B2 and C classes.

10. E class licenses issued to drivers controlling following types of cars:

a) Cars from 30 seats and over;

b) Cars intended for B1, B2, C and D classes.

11. Persons who have obtained B1, B2, C, D and E class licenses may haul another trailer with design loading capacity no more than 750 kg when controlling respective types of cars.

12. Issuance of F class licenses to persons who have obtained B2, C, D and E class licenses for controlling respective types of cars hauling another trailer with design loading capacity more than 750 kg, semi-trailer, articulated buses is prescribed as follows:

a) FB2 class issued to drivers for controlling B2 class cars hauling another trailer and may control types of cars intended for B1 and B2 classes;

b) FC class issued to drivers for controlling C class cars hauling another trailer, semi-trailer trucks and may control types of cars intended for B1, B2, C and FB2 classes;

c) FD class issued to drivers for controlling D class cars hauling another trailer and may control types of cars intended for B1, B2, C, D and FB2 classes;

d) FE class licenses issued to drivers for controlling E class cars hauling another trailer and may control articulated buses and types of cars intended for B1, B2, C, D, E, FB2 and FD classes.

13. License classes for drivers controlling sleeper buses, city passenger buses (used for transport business) are prescribed in Clause 9 and 10 hereof. The number of seats in a car is determined according to the number of seats in the same type of bus or passenger cars with the same size limit.

As regulated above, there are following types of driver licenses in Vietnam: A1, A2, A3, A4, B1 class (automatic transmission) issued to persons who do not practice as a driver, B1 class licenses issued to persons who do not practice as a driver, B2, C, D, E, F, FB2, FC, FD,FE.
