Pursuant to Article 24 of the Law on Road 2024 on road traffic safety structures in Vietnam

Article 24. Road traffic safety structures

Road traffic safety structures are constructed, installed, and arranged to ensure the safety of people and vehicles participating in road traffic, including:

  1. Emergency escape lanes constructed on steep inclines to allow vehicles that have lost control when descending to exit the main road, reduce speed, and ensure a stop;
  1. Rescue tunnels associated with road tunnels, serving for evacuation, rescue, and emergency responses when main tunnels have incidents or are used for the maintenance of road tunnels. Rescue tunnels are not used for the passage of traffic vehicles;
  1. Protective walls, barriers, and guardrails placed in dangerous positions to prevent vehicles from veering off the traffic road in case of an uncontrolled incident.

In cases where markers are not simultaneously arranged, reflective markers or paint must be affixed to protective walls and guardrails to warn road users of dangerous positions and guide them to navigate correctly along the roadway;

Who is responsible for installing road traffic safety structures in Vietnam?

According to Article 25 of the Law on Road 2024, the regulation on Traffic arrangement is as follows:

Article 25. Traffic arrangement

3. The developer of road structure construction project, road management, and users, along with related organizations and individuals, are responsible for fully installing, adjusting, and supplementing road signs and road traffic safety structures for the projects and roads under their management; implementing the approved Traffic arrangement plan for highways.

4.  Monitoring and assessing traffic conditions on the routes, adjusting Traffic arrangement to mitigate traffic congestion, and ensuring road traffic order and safety are carried out during the operation, exploitation, and maintenance of roads.

5. The Ministry of Transport and People's Committees at all levels are responsible for organizing traffic on roads within their management scope.

6. Road managers and users of dedicated roads are responsible for organizing traffic on dedicated roads; in cases where public traffic operates on the dedicated roads, traffic must be organized according to this Article.

7. The Government of Vietnam provides detailed regulations for this Article.

Thus, the developer of road structure construction project, the road management, and users, as well as related organizations and individuals, are responsible for installing road traffic safety structures for projects and routes within their management scope.

What are road operation principles in Vietnam?

Pursuant to Article 3 of the Law on Road 2024 on road operation principles in Vietnam:

- Ensuring smooth, safe, seamlessly connected, efficient, environmentally friendly traffic, serving the needs of convenient cargo transportation and travel for the public, contributing to socio-economic development, ensuring national defense, security, and environmental protection, disaster prevention, and international integration.

- Developing the road network according to plan; efficiently using resources; connecting road transportation with other modes of transportation; enhancing the application of advanced science and technology, ensuring civility, modernity, and coherence.

- Implementing uniformly based on specific delegation and decentralization of responsibilities and powers, as well as close cooperation between ministries, sectors, and local authorities at all levels.

- All acts violating road operation laws must be detected, promptly prevented, and strictly handled in accordance with the law.
