What are regulations on the work of ensuring security and safety for fuel and refueling for private planes and commercial planes of Vietnam?

Pursuant to Article 30 of the Circular 25/2022/TT-BGTVT (effective from 15/12/2022) stipulating regulations on the work of ensuring security and safety for fuel and refueling for private planes and commercial planes of Vietnam as follows:

1. Vietnamese airlines conducting private planes, commercial planes shall check and supervise the quality and safety assurance of fuel and the process of fueling and refueling for flights of private planes, commercial planes. Vietnam according to the provisions of Circular No. 04/2018/TT-BGTVT dated January 23, 2018 of the Minister of Transport providing for technical assurance of aviation fuel (hereinafter referred to as Circular No. 04/2018/TT-BGTVT dated 23/01/2018).

2. Units providing fuel services for private planes in Vietnam must ensure that fuel refueling trucks for special aircraft and special compartments of Vietnam are inspected and in good condition; must be approved by the head of the vehicle-using unit in the list of vehicles allowed to serve Vietnam's private planes.

3. Fuel before being loaded onto Vietnam's private planes, commercial planes must have quality certifications meeting the requirements specified in Circular No. 04/2018/TT-BGTVT dated January 23, 2018. The fuel quality certifications must be signed by the head or authorized person of the fuel supplier and the person in charge of the laboratory and must be valid.

4. The remaining fuel on the aircraft before refueling must be checked by a Vietnamese airline that conducts private planes, commercial planes for quality inspection according to the aircraft maintenance manual; The remaining fuel on the aircraft that does not meet the requirements must be withdrawn from the aircraft, the aircraft's fuel tanks must be treated according to regulations before refueling to ensure that the fuel when loaded into the aircraft is not affected or altered in accordance with the standard.

5. Security checks for loading and unloading vehicles and drivers and other people on duty according to the refueling vehicle (if any) of the unit refueling private planes, commercial planes of Vietnam before entering the flight area in Vietnam:

a) After receiving fuel at the depot, the loading and unloading vehicles must be sealed with the discharge and intake doors. In case the vehicle for refueling and refueling Vietnam's private planes, commercial planes passes through an area other than a restricted area, one vehicle must be arranged to follow as a security guard, accompanied by a aviation security officer of the loading unit accompanied by escort; refueling vehicles must be fitted with cameras and equipped with cruise monitoring devices;

b) The aviation security control force at the airport or aerodrome is responsible for checking all passengers accompanying the vehicle and the means of refueling the aircraft, ensuring that the aircraft's discharge and loading ports are convenient loading and unloading sealed before entering the restricted area;

c) The loading and unloading unit strictly follows the process of checking the loaded vehicle and the fuel quality control process before performing the filling.

6. Security and safety inspection and supervision before and during refueling on private planes, commercial planes of Vietnam:

a) The refueling on private planes, commercial planes in Vietnam is carried out under the direct supervision of the supervision team with the following members: representatives of the Port Authority; representative of the technical team to prepare private planes, commercial planes of Vietnam; representative of Vietnam's airlines with private planes, commercial planes; representative of the airport or aerodrome operator; representative of the aviation security control unit at the airport or aerodrome; representative of the unit for refueling private planes, commercial planes of Vietnam; there is a record made by the representative of the Airport Authority;

b) The refueling on foreign aircraft is carried out under the direct supervision of the supervision team with the following members: representative of the technical team preparing the private planes; full-time security personnel of Vietnamese airlines accompanying the special aircraft (if any);

c) The monitoring team is responsible for: checking the legitimacy of the fuel quality certifications; check the sealing of the discharge and intake ports of the loading and unloading vehicles; supervise the entire process of refueling the aircraft; supervise the sampling and sealing of samples after loading; supervise the visual inspection of aviation fuel before and during the refueling process according to the onboard refueling procedure in case the fueling is carried out in Vietnam.

7. Sampling, storing fuel samples and fuel quality test certificates in Vietnam:

a) Before refueling, the airline operating the special aircraft or special-cabin flight must carry out sampling with a capacity of at least 01 liter of fuel remaining on the aircraft and fuel stored on the vehicle for refueling, sealing and storing fuel samples; materials used to store samples must meet current Vietnamese or international standards for aviation fuel;

b) On each sample, it must be clearly stated: sample container, flight number, number of aircraft loaded, control plate of loading vehicle, time of sampling, name of sampler, date of sampling, name and the seal's signature and a sampling record signed by the sampler and supervisor;

c) The certifications of fuel quality, fuel samples loaded for sprivate planes and commercial planes must be kept at the fuel supply unit and the operator of the airport where the fuel is to be refueled until the Vietnamese private planes and commercial planes lands safely at the destination airport.

8. For foreign special aircraft flights, the assurance of security and fuel safety of private planes and commercial planes shall comply with the provisions of this Article.

What are regulations on ensuring security and food safety for meals served on private planes and commercial planes of Vietnam?

Pursuant to Article 31 of the Circular 25/2022/TT-BGTVT (effective from 15/12/2022) stipulating regulations on ensuring security and food safety for meals served on private planes and commercial planes of Vietnam as follows:

1. Vietnam's airlines and air meal service providers licensed by the Civil Aviation Administration of Vietnam are responsible for ensuring food security and safety for meals served for Vietnam's private planes and commercial planes Vietnam; seal and store meal samples for private planes and commercial planes for at least 24 hours from the time the meals are served on private planes and commercial planes.

2. The aviation security control force of the meal processing enterprise is responsible for coordinating with the airline conducting the special flight to conduct visual inspection of the meal serving for Vietnam's private planes and commercial planes before putting the meal container, securely sealing the meal container and arranging the aviation security control staff of the unit to escort the meal from the processing place to the planes.

3. Vietnam's airlines conduct flights by private planes and commercial planes coordinate with the Guard Command - the Ministry of Public Security in conducting testing of food and drink for security guards, and drinking water for security guards when they are on a business trip abroad.

4. The flight crew is only allowed to receive on board the aircraft's food containers for private planes and commercial planes with security seals intact.

In which cases is the aviation security inspection in Vietnam exempted?

Pursuant to Article 33 of the Circular 25/2022/TT-BGTVT (effective from 15/12/2022) stipulating cases of exemption from the aviation security inspection in Vietnam as follows:

1. Exemption from aviation security check for people and hand luggage of subjects who are allowed to serve of ensuring security and safety for fuel and refueling for private planes and commercial planes specified in Article 4, Decree No. 96/2021/ND-CP dated November 2 2021 by the Government on the guarantee of special aircraft and special-cabin flights.

2. The aviation security control force is responsible for coordinating with the units of the Guard Command - the Ministry of Public Security in checking the list of subjects exempt from aviation security inspection.
