Pursuant to Article 1 of the Decision 1309/QĐ-BGTVT in 2022 stipulating the position and function as follows:

1. The Inspector of the Ministry of Transport is an agency of the Ministry assisting the Minister in state management of inspection work, receiving citizens, settling complaints and denunciations, preventing and combating corruption, and conducting administrative inspections of agencies, organizations and individuals under the management of the Ministry of Transport; conduct specialized inspection of agencies, organizations and individuals under the scope of state management according to branches and domains of the Ministry of Transport; settle complaints and denunciations and prevent and combat corruption and negativity; internal audit in accordance with the law.

2. The Inspector of the Ministry of Transport is under the direction and administration of the Minister of Transport and under the direction of the Government Inspector in terms of work and instructions on organization and operations.

3. The Inspector of the Ministry of Transport has its own seal and has an account at the State Treasury; may use the seal of the Ministry when the Chief Inspector signs the document under the Minister's order.

1. 6. Propagate, guide, direct, inspect and urge agencies and units under the Ministry's management to implement the legal provisions on inspection, citizen reception, settlement of complaints and denunciations, anti-corruption, negative, internal audit.

7. Regarding inspection and examination:

a) Inspect and examine the implementation of policies and laws and the tasks and powers of agencies, organizations and individuals under the Ministry's direct management; inspect the state enterprises established by the decision of the Minister according to regulations;

b) Inspect and examine the observance of specialized laws, professional and technical regulations, and rules on management of branches and domains by agencies, organizations and individuals within the scope of state management of the Ministry. Transportation;

c) nspect and examine other cases assigned by the Minister;

d) Check the accuracy and legitimacy of inspection conclusions and post-inspection handling decisions of heads of agencies assigned to perform the specialized inspection function under ministries and chairpersons of provincial-level People's Committees with cases falling under the branches and domains under the State management of the Ministry of Transport when necessary;

dd) A decision on re-inspection of a case within the scope and state management competence of the Ministry of Transport, which has been assigned by the head of the agency assigned to perform the specialized inspection function under the Ministry, the President of the People's Committee; the provincial level concludes but detects signs of law violation when assigned by the Minister;

8. Assist the Minister in organizing citizen reception, receiving and handling petitions, complaints and denunciations; handle complaints and denunciations according to regulations.

9. Regarding anti-corruption work:

b) Perform anti-corruption tasks as prescribed by law.

10. Assist the Minister in organizing the internal audit work; carry out internal audit at the Ministry and its affiliated units according to regulations;

11. Monitor, urge and inspect the implementation of conclusions, recommendations, post-inspection handling decisions, conclusions on settlement of complaints and denunciations of Ministers and Inspectors of the Ministry, and conclusions and recommendations. of the Government Inspectorate, other ministries and branches related to the responsibilities of the Ministry. 17. Coordinate with the Department of Personnel and Organization in recruitment; implementation of regimes and policies; The training and retraining of civil servants falls under the management of the Ministry Inspectorate.

18. Assume the prime responsibility for, and coordinate with the Department of Organization and Personnel in, building employment positions, civil servant rank structure, and managing, evaluating and classifying civil servants of the Inspector of the Ministry of Transport.

Coordinate with the Office of the Ministry and the Department of Organization and Personnel in performing the work of social insurance, health insurance, and settlement of sickness, maternity, occupational accident and occupational disease regimes for civil servants of Inspector of the Ministry of Transport.

20. Cooperate with the Office of the Ministry, the Information Technology Center and related organizations in receiving, processing, publishing, exploiting, managing documents and updating the database on the Portal.

21. Manage dossiers and documents, submit and store according to the provisions of law.

22. Perform other tasks and exercise other powers as prescribed by law on inspection, complaint, denunciation, anti-corruption or as assigned by the Minister.

1. Organizational structure

a) Leader of the Inspector of the Ministry of Transport:

The Ministry Inspectorate's leadership includes Chief Inspector and Deputy Chief Inspectors.

The number of Deputy Chief Inspectors shall comply with the provisions of law and the Ministry of Transport.

The Chief Inspector is responsible before the Minister and before the law for the performance of the assigned tasks and powers of the Inspector of the Ministry of Transport.

Deputy Chief Inspectors are responsible before Chief Inspectors and before law for the performance of assigned tasks and powers.

b) Organizations under the Ministry Inspectorate, including:

- Planning - General Department (Inspection Division 1);

- Administrative Inspection Division (Inspection Division 2);

- Specialized Inspection Division (Inspection Division 3);
