What are the procedures for drafting and approving the annual maintenance plan for maritime works managed by the Ministry of Transport in Vietnam?

According to Clause 4 of Article 7 of Circular 19/2022/TT-BGTVT, the following regulations are the procedures for drafting and approving the annual maintenance plan for maritime works:

a) Every year, based on the technical condition of the work, information on the scale and structure of the work, the history of maintenance of the work, the actual situation of the navigation channel, water area, and water area, other information and data, technical standards, maintenance procedures, and economic-technical standards, the Vietnam Maritime Administration reviews, summarizes, and drafts the plan and estimated budget for the need for maintenance of maritime works for the following year for submission to the Ministry of Transport before May 30 of each year;

b) The Ministry of Transport reviews and approves the plan for the need for maintenance of the work for the following year before June 30 of each year; summarizes the plan and estimated budget for maintenance into the annual budget of the Ministry of Transport;

c) Based on the Decision on the allocation of the budget of the Ministry of Finance and the budget for the maintenance of maritime works, the Vietnam Maritime Administration organizes a review of the list of works and necessary work items, drafts the plan and estimated budget for the maintenance of maritime works, and submits it to the Ministry of Transport no later than 15 days from the date of receiving the notification of the budget of the Ministry of Transport;

d) The Ministry of Transport organizes the approval of the maintenance plan for maritime works no later than 15 days from the date of receiving the report from the Vietnam Maritime Administration.

According to Clause 6 Article 7 of Circular 19/2022/TT-BGTVT, the following is stipulated:

6. The annual maintenance plan for maritime works approved by the Ministry of Transport is one of the basis for the Vietnam Maritime Administration and the managers, operators, and users to implement.
