Pursuant to Article 6 of Decree 168/2024/ND-CP on penalties and deduction of points from driver licenses of drivers of cars, four-wheeled passenger vehicles with engines, four-wheeled freight vehicles with engines, and vehicles similar to cars violating road traffic laws:

Article 6. Penalties and deduction of points from driver licenses of drivers of cars, four-wheeled passenger vehicles with engines, four-wheeled freight vehicles with engines, and vehicles similar to cars violating road traffic laws

  1. A fine ranging from 800,000 VND to 1,000,000 VND shall be imposed on drivers committing any of the following violations:

k) Failing to fasten the seat belt when driving the vehicle on the road;

l) Carrying passengers in a car without fastening the seat belt (at positions equipped with seat belts) when the vehicle is in motion;

Pursuant to Clause 4, Article 12 of Decree 168/2024/ND-CP on penalties and deduction of points from driver licenses for other violations of road traffic rules; the use of roadways and sidewalks for other purposes:

- A fine ranging from 800,000 VND to 1,000,000 VND: For not wearing a seat belt when driving on the road

- A fine ranging from 800,000 VND to 1,000,000 VND: For carrying passengers in a car without fastening the seat belt (at positions equipped with seat belts) when the vehicle is in motion

- A fine ranging from 350,000 VND to 400,000 VND: For passengers in a car not wearing a seat belt (at positions equipped with seat belts) when the vehicle is in motion

Is it mandatory to fasten a seat belt in Vietnam?

Pursuant to Article 10 of Law on Road Traffic Order and Safety 2024 on general rules:

Article 10. General rules

  1. Road traffic participants must travel on the right side according to their direction, follow the correct lane and road section regulations, comply with road signals, and adhere to other road traffic rules.
  1. Drivers and passengers in cars must fasten their seat belts at positions equipped with seat belts when participating in road traffic.
  1. When transporting children under 10 years old and less than 1.35 meters in height in a car, the child must not sit in the same row of seats as the driver, except for cars with only one row of seats. The driver must use and instruct on using appropriate child safety devices.

According to the above regulations, drivers and passengers in cars are required to fasten their seat belts at positions equipped with seat belts when participating in road traffic.

Are automobiles carrying preschool children in Vietnam required to be equipped with seat belts?

Pursuant to Article 46 of Law on Road Traffic Order and Safety 2024 on ensuring road traffic order and safety for cars transporting preschool children and students:

Article 46. Ensuring road traffic order and safety for cars transporting preschool children and students

  1. Cars providing transportation services for preschool children and students must meet the following requirements:

a) Ensure the conditions stated in Clauses 1 and 2, Article 35 of this Law; have devices for recording images of preschool children and students, devices with warning and anti-forgetting functions for children on the vehicle; have a service life not exceeding 20 years; be painted in accordance with the regulations of the Government of Vietnam;

b) Cars transporting preschool children or primary students must have seat belts appropriate for the age or use vehicles with seats suitable for the age according to the law.

  1. Cars providing transportation services combined with pickup and drop-off services for preschool children and students must meet the requirements stipulated in Clause 3, Article 10, Clauses 1 and 2, Article 35 of this Law; have devices for recording images of preschool children and students, devices with warning and anti-forgetting functions for children on the vehicle, meeting the requirements stipulated in point a, clause 1 of this Article.
