On October 24, 2024, the Government of Vietnam promulgated Decree 139/2024/ND-CP regulating the procedures forinterception flights, escorting flights, and forced landing of aircraft violating Vietnam's airspace to land at airports; forces for intercepting, escorting, and compelling such aircraft to land.
However, unmanned aircraft and ultralight vehicles are not within the scope of Decree 139/2024/ND-CP.
Decree 139/2024/ND-CP applies to Vietnamese organizations and individuals and foreign organizations and individuals with civil aviation activities in the Vietnamese airspace; agencies, units managing and operating airports in Vietnam.

What are the procedures for forced landing of aircraft violating Vietnam's airspace?
According to Article 7 of Decree 139/2024/ND-CP, which regulates the procedure for forced landing of aircraft violating Vietnam's airspace to land at airports:
Article 7. Procedures for forced landing of aircraft violating Vietnam's airspace to land at airports
- Aircraft tasked with compelling approach the violating aircraft according to the following method:
a) Aircraft tasked with compelling approach the violating aircraft from behind on the left or right side, suitable to the operational and observational conditions; then establish a suitable speed and distance to ensure safety, while emitting signals and actions; simultaneously ensuring that the pilot (crew) of the violating aircraft can receive the signals and actions requiring landing at the designated airport;
b) Once the violating aircraft has safely landed at the designated airport, the compelling aircraft retreats from the area or lands according to the military commander's orders.
- Conditions for the designated airport
The airport must meet technical conditions to accommodate the landing of the violating aircraft; the terrain around the airport must be suitable for flight circles, approaches to the airport for landing; the violating aircraft must have sufficient fuel to reach the designated airport. Priority is given to designating airports involved in civilian aviation activities.
Thus, aircraft tasked with compelling approach the violating aircraft in Vietnamese airspace according to the following method:
- The compelling aircraft approaches the violating aircraft from behind on the left or right side, suitable to the operational and observational conditions; then establishes a suitable speed and distance to ensure safety, while emitting signals and actions; simultaneously ensuring that the pilot (crew) of the violating aircraft can receive the signals and actions requiring landing at the designated airport.
- Once the violating aircraft has safely landed at the designated airport, the compelling aircraft retreats from the area or lands according to the military commander's orders.
Which agency is responsible for organizing the interception, escorting, and forced landing of aircraft violating Vietnam's airspace to land at airports?
According to Article 15 of Decree 139/2024/ND-CP, the Ministry of National Defense:
Article 15. Ministry of National Defense
- Takes the lead in organizing the interception, escorting, and forced landing of aircraft violating Vietnam's airspace to land at airports.
- Leads and cooperates with the Ministry of Transport and other ministries, central authorities, and People's Committees of provinces and centrally-governed cities with airports to deploy forces for organizing interception, escorting, and forced landing of aircraft violating Vietnam's airspace to land at airports.
- Instructs agencies, units to develop plans, enhance training for scenarios of interception, escorting, and forced landing of aircraft violating Vietnam's airspace suitable to the nature of the mission and types of aircraft in use by the unit.
According to the above regulations, the Ministry of National Defense of Vietnam is responsible for leading the organization of interception, escorting, and forced landing of aircraft violating Vietnam's airspace to land at airports.
