What are cases where traffic polices are allowed to use made-ups to do their duty in Vietnam? What are patrol and control methods of traffic polices in Vietnam?

Many times when I go on business trips to a province neighboring Ho Chi Minh City, police officers in plainclothes come and ask me to stop the car. So, may I ask, in what cases are traffic police on duty wearing plain clothes? What are patrol and control methods of traffic police?

What are cases where traffic polices are allowed to use made-ups to do their duty in Vietnam?

Pursuant to Clause 1, Article 11 of Circular 65/2020/TT-BCA on costumes; mean of transportation; Vehicles, professional technical equipment and weapons and combat gears of the Traffic Police force:

1. Traffic Police uniform

a) Traffic police, when patrolling, controlling, and handling violations, use police uniforms and wear People's Police numbers according to regulations of the Ministry of Public Security. When controlling in the evening, at night or during the day in foggy weather or bad weather that limits visibility, you must wear reflective clothing;

b) In case of control through means and professional technical equipment, a section of plainclothes Traffic Police shall be arranged to operate and use means and professional technical equipment and monitor the situation and safety, detecting violations of road traffic laws and other violations of law. When detecting a violation, immediately notify the patrol and public control department to conduct control and handle according to the provisions of law;

Head of Road Traffic Control and Patrol Guidance Department under the Traffic Police Department (hereinafter referred to as Head of Road Traffic Control and Patrol Guidance Department), Head of Traffic Police Department, Head of Police Districts, districts, towns, provincial cities, and centrally run cities (hereinafter collectively referred to as district-level Police Chiefs) or higher decide whether to wear police uniforms or plain clothes when using vehicles and equipment. Professional technical equipment and must be clearly stated in the patrol and control plan.

Thus, plainclothes traffic police only operate in schools to operate and use vehicles and professional technical equipment, monitor traffic order and safety, and detect violations of  Road traffic laws and other violations of law in Vietnam.

What are patrol and control methods of traffic polices in Vietnam?

In Article 9 of Circular 65/2020/TT-BCA on forms of patrol and control as follows:

1. Patrol and mobile control

Traffic police move on assigned routes and areas by means of transport or on foot to patrol and control according to plans approved by competent authorities, directly supervise or through the use of Means and professional technical equipment to monitor, prevent, detect, promptly stop and strictly handle road traffic violations and other violations according to the provisions of law.

2. Control at the Traffic Police Station or at a point on the road

a) Traffic police organize forces at the Traffic Police Station or at a point on the road according to a plan approved by competent authorities to carry out: General control of road vehicles; Control and handle violations by implementing peak patrol and control; Control and handle violations by topic; Control through professional technical means and equipment; Coordinate with relevant units and agencies to prevent and fight crime, ensure order, traffic safety, security, order and social safety; Perform other tasks as directed by competent authorities according to the provisions of law;

b) At the Traffic Police Station, install and use professional technical equipment to record video in the control area. At a point on the road, choose a location with a wide, airy road surface that does not obscure visibility and complies with the law. When controlling in the evening, there must be lights and adequate lighting at night.

3. Patrolling, mobile control combined with control at one point or at the Traffic Police Station

When patrolling, mobile control is controlled at a point on a traffic road, at a Traffic Police Station or when controlling at a point on a traffic road, at a Traffic Police Station that is patrolled, mechanically controlled but must be clearly stated in the patrol and control plan approved by competent authorities.

According to this Article, traffic police can patrol and control in different ways such as patrolling, mobile control; control at the Traffic Police Station or at a point on the road; patrolling, mobile control combined with control at one point or at the Traffic Police Station in Vietnam.
