Transport Vehicles for Staff Must Carry the Employee Transport Contract During Transit?
In Clause 6 Article 7 of Decree 10/2020/ND-CP, it is stipulated as follows:
Transport business units that transport passengers according to contracts, drivers transporting students, and staff going to school or work
- Before executing the contract, the transport business unit must notify once the minimum contents of the contract as prescribed in Clause 2 (excluding point e, point g) Article 15 of this Decree; and must notify again when there are changes in the route, transportation time, or stopping and boarding/drop-off points;
- Transporting the correct subjects (students, staff going to school or work) and not required to implement the provisions specified in point c, point d Clause 3, point b, point c Clause 4, and Clause 5 of this Article.
Referring to Points b, c Clause 4 of this Article:
When transporting passengers, in addition to the documents required to be carried under the Road Traffic Law, the driver must also comply with the following regulations:
- Carry the passenger list with the transportation business unit's confirmation stamp (except for the case specified in point c of this clause);
- In case of using electronic contracts, the driver must have a device to access the contents of the electronic contract and the accompanying passenger list provided by the transport business unit;
=> Thus, based on the above basis, when transporting staff, the vehicle is only required to carry documents as specified in the Road Traffic Law and is not required to carry a passenger transport contract.
