The procedure for negotiating construction specifications for inland ports and docks

Clause 5, Article 15 of Decree 08/2021/ND-CP stipulates the agreement procedure as follows:

- Inland waterway port receiving foreign waterway vessels:

The investor submits 02 sets of documents directly or by other appropriate means to the Vietnam Inland Waterways Administration (for inland waterway ports as specified in point b, clause 2 of this Article), Department of Transport (for inland waterway ports as specified in point c, clause 2 of this Article) for appraisal. Within 05 working days from the date of receipt of the complete dossier as prescribed, the Vietnam Inland Waterways Administration, Department of Transport shall appraise the dossier; if it meets the conditions, it shall send an appraisal result report and 01 set of documents to the Ministry of Transport.

Within 05 working days from the date of receipt of the appraisal report from the Vietnam Inland Waterways Administration or the Department of Transport, the Ministry of Transport shall consult the Ministry of National Defense, Ministry of Public Security, and Provincial People's Committee on ensuring national defense and security for the construction of inland waterway ports; within 05 working days from the date of receipt of the written request from the Ministry of Transport, the Ministry of National Defense, Ministry of Public Security, and Provincial People's Committee shall provide written opinions to the Ministry of Transport. Within 05 working days from the date of receipt of the unified document from the Ministry of National Defense, Ministry of Public Security, and Provincial People's Committee, the Ministry of Transport shall issue a written agreement on construction technical specifications and send it to the investor;

- Inland waterway port not receiving foreign waterway vessels:

The investor submits 01 set of documents directly or by other appropriate means to the Vietnam Inland Waterways Administration or the Department of Transport. Within 05 working days from the date of receipt of the complete dossier as prescribed, the Vietnam Inland Waterways Administration or the Department of Transport shall issue a written agreement on construction technical specifications and send it to the investor;

- Inland waterway wharf:

The investor submits 01 set of documents directly or by other appropriate means to the Department of Transport. For inland waterway wharves on national inland waterways, specialized inland waterways connected to national inland waterways, before issuing a written agreement, the Department of Transport shall seek the opinion of the regional Inland Waterways Sub-Department. Within 05 working days from the date of receipt of the written request from the Department of Transport, the regional Inland Waterways Sub-Department shall provide a written response. Within 05 working days from the date of receipt of the document from the regional Inland Waterways Sub-Department, the Department of Transport shall issue a written agreement on construction technical specifications and send it to the investor;

- In the case of ports and inland waterway wharves within the seaport waters, before appraisal and agreement on construction technical specifications, the Vietnam Inland Waterways Administration or the Department of Transport shall seek the opinion of the Maritime Port Authority in writing. Within 05 working days from the date of receipt of the written request, the Maritime Port Authority shall provide a written response.
