The Number of Passengers Allowed in a 5-Seater Car
According to Clause 2 and Clause 4, Article 23 of Decree 100/2019/ND-CP, it is stipulated:
- A fine ranging from 400,000 VND to 600,000 VND per person in excess of the permitted capacity of the vehicle, but the total maximum fine does not exceed 40,000,000 VND applies to drivers of passenger cars and passenger vehicles (excluding buses) who commit the following violations:
+ Carrying more than 02 people on a 9-seater vehicle,
+ Carrying more than 03 people on a 10-seater to 15-seater vehicle,
+ Carrying more than 04 people on a 16-seater to 30-seater vehicle,
+ Carrying more than 05 people on a vehicle with over 30 seats, except for violations specified in Clause 4 of this Article.
- A fine ranging from 1,000,000 VND to 2,000,000 VND per person in excess of the permitted capacity of the vehicle, but the total maximum fine does not exceed 40,000,000 VND applies to drivers of passenger cars running routes over 300 km who commit the following violations:
+ Carrying more than 02 people on a 9-seater vehicle,
+ Carrying more than 03 people on a 10-seater to 15-seater vehicle,
+ Carrying more than 04 people on a 16-seater to 30-seater vehicle,
+ Carrying more than 05 people on a vehicle with over 30 seats.
=> Thus, according to the above regulations, a 5-seater car is allowed to carry up to 1 extra person. In cases where more than 1 extra person is carried, administrative penalties will be applied as specified above. The editorial board responds with this information.
