Riding a Motorcycle with Three Persons on a Highway: How Much is the Penalty?
Basis for Penalty: Article 6 of Decree 100/2019/ND-CP.
Regarding this case, two violations can be identified as follows:
First Violation: Carrying more than two passengers on a motorcycle (understood as carrying two additional passengers on the vehicle).
Point l Clause 2 Article 6 stipulates:
- A fine ranging from 200,000 VND to 300,000 VND shall be imposed on the driver of a motorcycle who commits one of the following violations:
l) Carrying more than two passengers on the vehicle, except in cases of transporting people in need of emergency medical aid, children under 14 years old, or escorting individuals who have violated the law;
For this violation, the driver will be fined from 200,000 VND to 300,000 VND.

Second Violation: Driving on the expressway.
Point b Clause 6 Article 6 stipulates:
- A fine ranging from 2,000,000 VND to 3,000,000 VND shall be imposed on the driver of a motorcycle who commits one of the following violations:
b) Driving on the expressway, except for vehicles serving the management and maintenance of the expressway;
For this violation, the driver will be fined from 2,000,000 VND to 3,000,000 VND.
Thus, the total fine for the case of the driver carrying more than two passengers on the expressway is from 2,200,000 VND to 3,300,000 VND (The specific fine in the absence of any mitigating or aggravating circumstances is 2,750,000 VND).
