Regulations on the Management of Private Housing Construction
According to Article 9 of Decree 06/2021/ND-CP on the management of detached house construction as follows:
The management of detached house construction shall be implemented based on the principle of ensuring the safety of humans, property, equipment, works, adjacent constructions, and the surrounding environment.
Design of detached houses for households and individuals:
a) For detached houses of households and individuals without basements, with a total construction floor area of less than 250 m2 or under 3 floors, or with a height of less than 12m, the investor of the detached house is permitted to organize and execute the construction design themselves;
b) For detached houses of households and individuals under 7 floors or with one basement, except for the cases specified in point a of this clause, the design must be carried out by organizations or individuals qualified in accordance with legal regulations;
c) For detached houses of households and individuals from 7 floors and above or with 2 basements and above, the design documents must be verified for construction safety before applying for a construction permit. The design and verification must be conducted by organizations or individuals qualified in accordance with legal regulations.
- Management of construction execution of detached houses for households and individuals:
a) The investor of the detached house shall organize the construction execution, supervise the construction, and be responsible for safety during the construction. It is encouraged that the investor of the detached house organizes the supervision of the construction, prepares, and retains the detached house documents as prescribed in this Decree, except for cases specified in point b of this clause;
b) For detached houses specified in point c, clause 2 of this Article, the construction execution and construction supervision must be conducted by organizations or individuals qualified in accordance with legal regulations.
- Contents of supervision of the construction of detached houses for households and individuals:
a) Construction methods, measures to ensure the safety of the house and adjacent constructions;
b) Quality of materials, construction components, and equipment before putting them into construction;
c) Scaffolding systems, temporary support structures, and machinery and equipment serving the construction;
d) Measures to ensure labor safety and environmental hygiene during the construction process.
- In addition to the regulations in this Article, the construction of detached houses must comply with other relevant legal regulations and the legal regulations on project management in construction investment in cases where the detached house is part of a construction investment project.
