What are principles for motor vehicle inspection services in Vietnam?

Pursuant to Article 4 of the Decree 139/2018/NĐ-CP (amended by Clause 3 Article 1 of the Decree 30/2023/NĐ-CP) stipulating principles for motor vehicle inspection services in Vietnam as follows:

- Only holders of certificates of eligibility for motor vehicles inspection (herein referred to as “certificate of eligibility”) are eligible for provision of motor vehicle inspection services.

- The inspection shall be independent, objective, transparent and compliant with regulations of law.

- If registration units fail to meet the demands for inspection of organizations and individuals, registration units and personnel of the People's Police and the People's Army may participate in assistance in inspecting motor vehicles within the scope of this Decree.

- The construction and establishment of a registration unit shall be consistent with provincial planning, specialized planning and relevant planning, especially specific factors of local areas, remote areas, mountainous areas and islands; and the number of and the density of vehicles registered in local areas. The application of modern technology and equipment for inspection is encouraged.

- The location of the registration unit shall comply with regulations on connection of the traffic system; be convenient for entry, exit and inspection of motor vehicles; ensure safety and convenience during operation and not cause obstruction and traffic jams, especially in large urban areas.

What are regulations on operation of the registration unit in Vietnam?

Pursuant to Article 25 of the Decree 139/2018/NĐ-CP (amended by Clause 20 and 21, Article 1 of the Decree 30/2023/NĐ-CP) stipulating operation of the registration unit in Vietnam as follows:

- Perform inspection and issue inspection certificates to motor vehicles in compliance with technical regulations and standards and guidelines relevant to inspection.

- Maintain facilities, organizational structure and personnel according to regulations of this Decree; ensure that testing equipment and instruments normally operate; ensure inspection and calibration of testing equipment and instruments in accordance with the law on measurement. During the inspection, the registration unit shall comply with regulations of law on environmental protection, occupational safety and hygiene, fire safety and fighting.

- Collect service charges and fees for motor vehicle inspection and other amounts receivable (if any) and fulfill financial liabilities as per the law.

- Within 18 months since the certificate of eligibility is issued, the registration unit should construct, apply and maintain quality management system according to ISO 9001;

- Post at inspection stations procedures and content of inspection; schedule of prices, fees, charges, inspection cycle, hot lines of the Vietnam Register and other notifications as prescribed.

- Transmit data and send reports as prescribed.

- Manage and issue templates and inspection certificates in accordance with regulations.

Officially remove the limit on the number of motor vehicles to be inspected by registration unit in Vietnam

Pursuant to Article 26 of the Decree 139/2018/NĐ-CP stipulating number of motor vehicles to be inspected by registration unit as follows:

Number of motor vehicles to be inspected by registration unit

Number of motor vehicles to be eligible for issue of inspection certificates in a day (within eight working hours) should meet simultaneously following requirements:

1. No more than 20 vehicles/day if each inspector takes charge of one vehicle; no more than 20 times the number of inspectors/day (number of inspector multiplying by 20) if more than one inspector takes charge of one vehicle.

2. No more than 90 vehicles for one type I inspection line and no more than 70 vehicles for one type II inspection line. If the type II inspection line is only used to inspect a motor vehicle with weight distributed on each single axis up to 2,000 kg, the number of vehicles for inspection is the same as the type I inspection line.

Pursuant to Clause 1 Article 2 of the Decree 30/2023/NĐ-CP stipulating annulment of some Clauses related to number of motor vehicles to be inspected by registration unit as follows:

Annulment of some Clauses and Articles; replacement of phrases; replacement and amendments to some Appendices of Decree No. 139/2018/ND-CP

1. Clause 2 Article 2, Clause 5 Article 11, Article 17, Article 21, Article 22, Article 23 and Article 26 shall be annulled.

As regulations above, from 8/6/2023, regulations on the number of motor vehicles to be inspected by registration unit in Vietnam will be annuled, which means the limit on the number of motor vehicles to be inspected by registration unit in Vietnam will be removed.
