Non-compliance with Traffic Police Orders: Penalties and Consequences

Recently, my son went to Saigon to submit his university entrance exam application. He traveled by motorcycle and was stopped by the police. Due to extreme fear, he fled but was subsequently pursued and apprehended by the police. Currently, my motorcycle has been impounded by the police, and its documents have also been confiscated. The police have requested that the vehicle owner come to pay the fine. I would like to inquire with the editorial board about how my son will be penalized in this case?

Based on Clause 2, Article 11 of the 2008 Road Traffic Law regarding compliance with traffic signals:

- When there is a traffic controller, road users must comply with the orders of the traffic controller.

According to Decree 100/2019/ND-CP on handling administrative violations in the field of road and railway traffic, vehicle operators who do not stop when required by traffic police (CSGT) will be fined and subjected to the following additional penalties:

- For car operators and similar vehicles, if they do not comply with the orders or guidance of the traffic controller or traffic inspector, they will be fined from 3 million VND to 5 million VND. (Point b Clause 5 Article 5 of Decree 100/2019/ND-CP)

- For motorcycle and motorbike (including electric motorbike) operators, similar vehicles to motorcycles, and similar vehicles to motorbikes, if they do not comply with the orders or guidance of the traffic controller or traffic inspector, they will be fined from 600,000 VND to 1,000,000 VND (according to Point g Clause 4 Article 6). Additionally, they will have their driving licenses revoked for one to three months, and if an accident is caused, the driving license will be revoked for two to four months.
