Do I need to retake the driving test if my driving license has expired for 6 months?
Pursuant to Clause 1, Article 36 of Circular 12/2017/TT-BGTVT, regulations on reissuing driving licenses for individuals whose licenses have expired are as follows:
a) From 03 months to less than 01 year, from the expiration date, you must retake the theory test to be reissued with a driving license;
b) From 01 year and above, from the expiration date, you must retake both the theory and practical tests to be reissued with a driving license.
The dossier for retaking the test is implemented according to the regulations in Clause 3, Article 19 of this Circular.
Thus, according to the above regulation, if your driving license has expired for 6 months, you must retake the theory test to be reissued the driving license.
How much is the fine for using a driving license that has expired for 6 months?
According to Article 21 of Decree 100/2019/ND-CP, amended by Clause 11, Article 2 of Decree 123/2021/ND-CP, regulatory penalties for violations of the conditions for driving motor vehicles are as follows:
...
- A fine ranging from 10,000,000 VND to 12,000,000 VND will be imposed on drivers of cars, tractors, and similar vehicles for committing one of the following violations:
a) Having a driving license that is not suitable for the type of vehicle being driven, or having a driving license that has expired for 03 months or more;
b) Not having a driving license, or using a driving license not issued by a competent authority, or using a tampered driving license.
Therefore, if you use a driving license that has expired for 6 months, you will be fined from 10,000,000 VND to 12,000,000 VND. You should submit the dossier and retake the theory test to be reissued the driving license to avoid being checked and fined by the police.
