Answer:

Pursuant to Article 54 of the Law on Road Traffic in 2008 stipulating grant and withdrawal of registration papers and number plates of motor vehicles as follows:

1. Motor vehicles of lawful origin and satisfying the quality, technical safety and environmental protection standards under this Law will be granted registration papers and number plates by competent state agencies.

License plates for motor vehicles are only issued to vehicles that meet the requirements for documents, origin, and technical standards of the vehicle, and each motor vehicle is only issued one unique license plate.

License plates are issued to qualified motor vehicles so that state agencies can manage security and order as well as vehicles in accordance with regulations; at the same time, each vehicle is only issued one license plate.

One of the prohibited acts in the 2008 Road Traffic Law stipulates:

Production, illegal use, or buying and selling license plates for motor vehicles and specialized motorbikes.

Therefore, the law does not allow buying and selling license plates. However, if a vehicle is sold, it means that the buyer owns that license plate and the buyer must complete the transfer procedures according to the law.

Answer:

Pursuant to Clause 2 Article 58 of the Law on Road Traffic in 2008, when operating a vehicle, the driver shall carry the following papers:

- Vehicle registration paper;

- Driver license, for motor vehicle operators defined in Article 59 of this Law;

- Technical safety and environmental protection inspection certificate, for motor vehicles prescribed in Article 55 of this Law;

- Motor vehicle owner civil liability insurance certificate.

As regulations above, it is against the law for operating motorcycle without vehicle registration certificate in Vietnam.

Is a license plate a property in Vietnam?

I bought a car and had the police issue a license plate. Someone saw my license plate and wanted to buy it because it was compatible with their age. Pursuant to Article 54 of the Law on Road Traffic in 2008, motor vehicles of lawful origin and satisfying the quality, technical safety and environmental protection standards under this Law will be granted registration papers and number plates by competent state agencies.

Thus, based on the above regulations, it can be determined that the license plate is an effective tool for the state to manage motor vehicles, and at the same time, it determines the legal ownership of individuals over motor vehicles (which are assets of individuals and organizations).

On the other hand, according to the provisions of the Civil Code in 2015, property is an object, money, valuable papers, and property rights. Property includes real estate and movable property. Real estate and movable property can be current assets and future assets.

In this case, real estate includes: land; houses, buildings attached to land; other properties attached to land, houses, and buildings; other properties as prescribed by law. Movable property is any property that is not real estate.

Pursuant to Clause 2 Article 8 of the Law on Road Traffic in 2008, the law prohibited illegally manufacturing, using or buying or selling number plates of motor vehicles and special-use vehicles.

Based on the above evidence, it can be determined that the license plate is only a government management tool. It is not considered to be property for civil transactions. The act of buying and selling license plates is a violation of the law.

Therefore, in the case of you buying a car and having the license plate issued by the police, and someone sees your license plate and wants to buy it because it is beautiful and compatible with their age. However, the license plate is not your property, so you should not engage in a transaction to buy and sell the license plate with this person, as this is a violation of the law.

If the person sees your license plate and wants to buy it because it compatible with their age, you and the person can negotiate to buy your car (if you agree) and register the car to the new owner according to the provisions of the law in Circular 15/2014/TT-BCA.
