Inspection and Issuance of Permits for Watercraft and Seaplanes Entering and Leaving Inland Waterway Ports and Terminals
Article 54 of Decree 08/2021/ND-CP stipulates the inspection and issuance of permits for vehicles and seaplanes entering or leaving inland ports and wharves as follows:
The applicant can choose one of the methods specified in Clause 1, Article 51 of this Decree to carry out procedures for vehicles and seaplanes entering or leaving inland ports and wharves, as follows:
a) In the case of direct procedures at the procedure location, the applicant submits and presents the documents specified in Article 52 and Article 53 of this Decree to the Port Authority;
b) In the case of electronic procedures, the applicant provides the documents specified in Article 52 and Article 53 of this Decree on the electronic software (chosen by the applicant).
Inspection of crew and vehicle documents:
a) In the case of direct submission of documents from the applicant, the Port Authority checks the conformity of the documents as prescribed;
b) In the case of receipt of documents through electronic procedures, the Port Authority only checks the database without directly inspecting the documents of the vehicle, crew, and vehicle operator. If errors are detected, direct inspection will be conducted.
Inspection of the vehicle:
a) The Port Authority inspects the vehicle based on the safety and environmental protection certificates of the vehicle;
b) If violations are detected, the Port Authority notifies, handles, and guides the applicant to take corrective measures to ensure compliance.
Vehicles and seaplanes are granted permits to enter or leave inland ports and wharves when they meet the conditions specified in this Decree.
Vehicles granted permits to leave inland ports and wharves but remain anchored in the waters of the port or wharf for over 24 hours must renew the permit to adjust the time of departure from the port or wharf.
Permits for entry and exit of inland ports and wharves can be in paper form or electronic form. Permits for entry and exit of ports and wharves for vehicles and seaplanes follow Forms No. 37 and No. 38 in the Appendix issued with this Decree.
Permits for entry and exit of inland ports and wharves are issued by the Inland Waterways Port Authority, and permits for departure from seaports, ports, and inland wharves are issued by the Maritime Port Authority. These permits may be stored in paper or electronic format. The storage duration for paper permits for entry and exit of inland ports and wharves is 02 years from the date of issuance. After the storage period, the Port Authority and Maritime Port Authority are responsible for destroying the permits for entry and exit of inland ports and wharves.
