Pursuant to Clause 3.o Article 6 of the Decree 100/2019/ND-CP (amended by Clause 4.b Article 2 of the Decree 123/2021/ND-CP) stipulating penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules as follows:

o) Carrying a person who does not wear a motorcycle helmet or does not wear the motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted.
As regulations above, children under 06 years of age must wear helmets when being carried on mopeds and motorcycles.

b) Failure to wear a motorcycle helmet or wearing it improperly.

As regulations above, when carrying a person who does not wear a helmet, the vehicle operator shall be fined from VND 400,000 to VND 600,000.

Pursuant to Article 31 of the Law on Road Traffic in 2008 stipulating riders of and passengers on bicycles, operators of other rudimentary vehicles as follows:
Riders of and passengers on bicycles, operators of other rudimentary vehicles
1. Bicycle riders may carry only one person or two persons including an under-7 child.
Bicycle riders shall comply with the provisions of Clause 3, Article 30 of this Law; passengers on bicycles traveling on the roads shall comply with the provisions of Clause 4, Article 30 of this Law.
2. Operators of and passengers on motor bicycles shall wear safety helmets, properly fastening their chin straps.
3. Operators of other rudimentary vehicles may not travel two or more abreast, shall travel on the lane reserved for rudimentary vehicles, if such lane is available; when traveling at night, these vehicles must have signals at their front and rear. Operators of animal-drawn carts shall take measures to ensure public sanitation.
4. Goods loaded on rudimentary vehicles must ensure safety, without obstructing traffic and the operator’s view.
As regulations above, it is compulsory to wear helmet when being carried on electric bikes in Vietnam.
